Hello everyone,

It's been over a month since arriving in the US on a K1. My question is this, having called a local SSN office and being told that I cannot get one without an EAD, could womeone please direct me to the list that clearly says a K applicant can apply for a SSN without an EAD.

Yes I have looked at the document that refers to an RM number but its unclear to me too, so I would rather have soemthing more concrete to prove my point.

Many thanks

You can get an SSN, but you have to apply using your maiden name, not your married name. Unfortunately, not all SSA employees are educated on this. I made the mistake of trying to apply under my married name. If you still have 14 days left on your i-94, you can still get an SSN. If not, then you have to wait until you adjust your status before you can get the SSN (like me)

Here is a thread you might wanna read:

A person entering the US on a K-1 visa is classified as a "legal alien allowed to work". Because of this classification, you are eligible to apply for a SSN. The document you may have seen is this: https://secure.ssa.gov/apps10/poms.nsf/lnx/0110211530

When you go to the SSA office, make sure the application is filled out and the box checked legal alien allowed to work. If the clerk there tries to argue that you need the EAD before applying, you tell him/her to just look your information up in their computer. Your information will be in the system as eligible for a SSN, and once they verify that you are good to go. The problem is a lot of those people working there have no clue and won't even bother to look. If you still have problems with getting an SSN, either talk to a supervisor or go to a different SSA office.
