US citizen visiting foreign spouse for 2 months

Hi,

I'm a US Citizen and filed for IR-1/CR-1 for my spouse. It's still with Nebraska Service Center.

I stay in the US and never established any domicile outside the US.

Can I visit my foreign spouse for 2 months?

I'm still planning to come back in 2 months and submit my NVC packages from the US.

Will I have to prove my domicile in the US during the NVC stage if I stay with my spouse in foreign country for 2 months ?

Hello bk2014,

As long as you dont move out of your house, you dont have to prove your domicile.

I used to live with my parents, then I went to see my husband 3-4 times for about 3 months each time.

Since my mail was still going to my parents' home, that is my domicile.

So, as long as you keep your mail going to whatever address you have, or even if you move to a new address and receive mail there, it will be fine.

Establishing domicile would be needed if you, lets say, left the country for a year to live with your spouse, and was working there, and established domicile there. Since it will only be 2 months, it will be fine. You can go visit as many times, and for as much time as you want as long as you keep an address in the US.

A 2 months visit is no trouble at all, especially if you have the financial support aspect of the petition covered. I'd make sure you have someone check your mail regularly in case the government sends you something.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thank you so much for your quick reply...I also live with my parents like you did and planning to visit my spouse for 2 months.

Also, there will be NO joint-sponsors in my case since I'll be the only one who is sponsoring my spouse during AOS stage of NVC.
