AOS for an student (F1 Visa)

Timeline

Hi I am Andrea I am from Venezuela and I'm in the United State (Baltimore, MD) on a F1 student visa. Last summer I marrieded my boyfrined who is a US citizen. I haven't chenged my status and need to do it as soon as posible. I have two questions:

1. Can I follow the I-130/I-485 guide on how to file for a Spouse inside the US?

and

2. If I file me forms this week (Jan 29th) do I still need to take classes this semester to maintain my F1 or will I be ok since I am already in the process?

Yes, you follow those steps and file an I-130/I-485. Once you have filed your papers, you no longer need to attend school.

05/10/2007 -- Interview, Approved!

05/22/2007 GREEN CARD arrives!!!

02/2009 - File to lift conditions

I-765

12/14/2006--- Mailed EAD App.

01/20/2007--- Biometrics

02/09/2005-------Sent in request to Congressional office for assistance with expediting EAD.

02/13/2007 -------- EAD Approved!

02/26/2007 - ------EAD received

Removal of Conditions:

05/12/2009 -- Overnighted application by USPS express mail (VSC).

05/14/2009 -- Green Card expired.

05/23/2009 --- Check cleared bank.

05/26/2009 -- Received NOA (NOA date May 15, 2009, guess they aren't deporting me).

05/29/2009- Biometrics Notice date

06/01/2009- Received Biometrics Letter

06/18/2009 - Biometrics

09/23/2009 - date of decision to approve (letter received), just waiting for card. No online updates whatsoever.

I agree with Jane on the first part, but I'd check with your ISO (international student office) on the school attendance part. My understanding is that filing doesn't really _grant_ you any status, but you are not likely to get into trouble for not being in school after filing. A concern I'd have is what happens if for some reason (God forbid) you are denied, then you will find yourself out of status. I don't want to alarm you -getting approved after marriage to a USC is rather likely- but do think of a worst-case scenario.

As far as I know as soon as u apply for AOS u will not be F1 anymore even if u r denied.U cannot go back to your previous status.If u decide to quit school just be prepared to prove that you initial intent of coming here was to go to school and not get a green card.
