My wife, a naturalized US Citizen, has an active I-130 petition for her brother. The petition was approved (I-797 Notice of Action). Brother was married at the time the I-130 was filed. Since the petition was approved (he's now in the long line waiting for a visa number), he has divorced. Can anyone advise me as to what paperwork we need to file with the USCIS to notify the appropriate authorities of his change in marital status?

Thanks in advance for your help.

hi

you don't have to do anything now, when his priority date becomes current and he will need to send his civil documents, he can send in the divorce decree, plus in his forms he puts divorced. and also you won't be paying for her to immigrate as his spouse, since they are divorced

There is nothing to report here as suggested above. This visa category doesn't warrant it for this kind of situation because it will not affect his category in any way. When the time comes where he does the NVC process they will ask for all the civil docs. If he remarries, he would inform the NVC of this when his PD is current and is called for processing. Also, his then spouse would be given a conditional GC if they are married less than 2 years.

This does not constitute legal advice.
