CR1 visa Casablanca denied

Hi everyone I hope someone can give give me an idea what's going on.

I had my Interview in April 4th the consular put me in Administrative processing ( no document needed) after 40 days they contacted me for a second interview they took my passport. I waited another 40 days they called and asked me to come to the embassy so i did then they gave me back my passport and told me that my case will be returned to the USCIS for a review ( i was in shock). then she gave me a white paper.

Dear bla bla bla

Further action in your case has been suspended under section 221(g) of the United States immigration and nationality act (INA) of 1952. We are returning your petition to the department of home land security's United States citizen and immigration service (USCIS). If USCIS determines that the information we are providing constitutes a sufficient foundation for initiating revocation proceedings, you will be sent a notice of intent to revoke that includes a statement of the facts and evidence and you will have the opportunity to respond. you may wish to consult the USCIS website for more information on how to contact the USCIS office nearest the petitioner's residence in the U.S

What do i do? what's the nest step?

Should i hire a lawyer?

How long does this review take?

Any help will be much appreciated

Very sorry this happened to you. I'm not an expert in the denial area but this is definitely the time a lawyer can get involved. I would also recommend writing your state representatives in the federal government. My congressman's office has been a great resource for our case from the beginning which is now in AP.

Many threads I have read on denial also try to include more details about their specific case and why you would be denied. For example, non bona fide marriage, criminal record, national security concerns. If you have any insight I'm sure others will be able to offer better advice.

Your first step is to contact the US consulate in Casablanca and ask for the reason you were given a 221g.

Once you know the reason you can prepare more evidence or if its based on the income requirement - then either get a co sponsor or work to find a job that would give you an income that meets the 120% that the consular visa officer at the interview based on their personal choice can enforce.

Yes I highly recommend in such a situation - getting an immigration lawyer well versed in 221g cases. I recommend calling your local ACLU office (http://www.aclu-nca.org/ )and your local CAIR office for local recommendations.

Very sorry this happened to you. I'm not an expert in the denial area but this is definitely the time a lawyer can get involved. FYI, the sponsorship requirement is 125% of the federal poverty guidelines, and while I believe there is some discretion between 100-125% for K-1 cases, for CR-1's I've never seen personal discretion permitting an income lower than 125%. I have heard of a few instances where the CO required a higher percentage, though.

I suggest if anyone reading this has a personal recommendation for a lawyer, that they respond or PM you with a referral so you may find one that way. Joining groups on Facebook and asking there is another option. If you decide to hire a lawyer, I would make sure that he or she has experience fighting visa denials from MENA countries. It's a very niche area of experience. I know some couples here on VJ have recommended Mark Ellis, though I haven't worked with him personally. The vast majority of lawyers and even immigration lawyers won't know what they're getting into...
