Which visa do I need? I am from England and my wife is a US 'resident' and i want to apply so I can live and work in USA with her?

Hi all,

Just wondering which visa do I need to apply for and if anybody has any information on how to do this? (I am new to all of this). I have been married 18 months and my wife is Peruvian but resident of United states for 15 years (she is still waiting for her citizenship). I would like to live in USA with her and work… Anybody knows of which visa do I apply for? Greencard/work permit etc? and the processing times? best to go through a lawyer or makes no difference?
Any help would be greatly appreciated!

It is better to wait until your wife is officially a USC. After that then she can file petition for you under CR-1/IR-1 category.

Your wife sends an I-130 petition and then you have about 2 year wait for visa number to become available if she still is LPR - you will be under F2A category. If she naturalizes, she sends very same I-130 petition and you will be applying for IR-1/CR-1 visa, wait time is 6-12 months for all processing.

If you have no red flags, lawyer typically is a waste of money.

IR1 visas are taking over a year currently, but it's better than trying to wait for a priority date to become current. HOWEVER, she can start the process now, with the I-130 and then upgrade after she gets her citizenship, which I suggest doing.
