Yup. I just noticed I shouldv'e maybe posted this question in IR-1/CR-1 Spouse Visa forum. We currently both live in the US, my husband has been here for 15 years and never deported. He did enter illegally. Thanks rlyforever...I will shop around a bit more.

Excuse me.,.,.,after thousands of dollars, and going through 10 months and 4 days of a "Legal" visa.,.,.,.I personally have a problem with being here "illeagaly".,.,.,.,let alone 15 years.

But, the law is the law, and if there is a way to make this legal, so be it.,.,,.,good luck in your process!

^ Don't we all have a problem with people that are here illegally.

I don't think everyone has a problem with it, Just the people who get to watch them jump a fence or take a train and get entitled to a piece of the $101 billion in U.S. taxpayer funds :)

I came on this site strictly for advise and help. Not judgement. I did not fall in love and marry a "status" as I'm sure you did not either or you wouldn't be on this site. I would appreciate if judgements are not passed here as we all go through expensive, time consuming procedures. As for Laurel Scott, I just read her material on the Psych Eval and i do agree. We do have other hardships that are considered extreme. I think I may just skip the evaluation. I just don't want anything to hurt our chances.

I agree with canadian wife in that unless you have an already diagnosed mental illness I would skip the evaluation too. As for the others that post nonconstructive posts just ignore them as no one can ever please everyone. There is always something to complain about, good luck.

I would like to ask a question related to this thread please. I know the illegal immigrant in a situation like this could ultimately face deportation if denied a visa, but what are the repercussions for the citizen spouse who evaded immigration for several years? They cannot claim an illegal immigrant on taxes can they? Would that not constitute as tax fraud if they were to go through some processing? Or is this like an amnesty for the citizen spouse and their punishment is basically removing their loved one? I believe all of these questions are related to the situation in this thread.

If our I-601A is deniged, he can file again. They will not come after him if it is rejected unless he commits a crime or does something stupid. As for a citizen spouse, I do not believe there is any reprocussions at all, just loss of loved one. Also, in my case, my husband pays taxes on his income since he's been here. I wouldn't try to claim an alien on taxes. Not sure if that is legal or not. I would think not.

My wife filed a non-resident (alien) tax return in the U.S. for the years she was here as a student and also worked at school. If someone hasn't been filing tax returns, they may need to bring those up to date.
