Day 26 09/10/2014 received in the mail NOA I485 I765 I131 Bio appointment.

Day 38 09/22/2014 RFE on I485

Day 39 09/23/2104 Bio appointment walk in.

Day 48 10/02/2014 Received RFE in the mail

Day 78 11/02/2014 mailed the RFE to USCIS.

Day 95 11/19/2014 RFE received

11/06/2014 - "Testing and Interview" on I-485 (50)

11/14/2014 - Get the notification stating that our interview has been scheduled (58) on December 18th (92)

Another setback again on my American dream journey.

Yesterday I was so happy because the EAD and AP was approved. This morning I then called my employer if the job is still available for me and with all happiness the job is waiting for me and my employer is patiently waiting. (Ang ganda ng lola mo) lols.

So while waiting for my EAD and AP I happen to pass by the DMV office so I inquired if I can get my DL with my passport, marriage certificate, EAD, I797 C for I485(proof of filing adjustment of status) but to my dismay, the DMV official told me NO NO NO NO. Immigrants under K1 is required to present the permanent resident card before they can issue a license. She said since my k1 visa already expired as well as my I94 they will need the physical card.

I argued..and said that K1 visa is a 1 entry visa and after the holder enter the country automatically the visa expires, the 90 days is only a prescriptive period for you to get married.

But still I lost....rules are rules..

So I called up USCIS again and told them the issue...the agent said that I should get a driving license. I said no and requested for a SUP. The Sup then created a expedite request citing financial loss since my employer will not allow me to work without a Driving License.

I really dont know what I have done wrong in USA for me to experience this predicament. If my beauty is the culprit and the main reason I plead GUILTY. lols.. So I will have to apply a salesgirl job I guess...haahaa

You should try another dmv or speak to the supervisor at the dmv.

I did and we even have argued about the legal laws involving k1. The thing is there is a procedure by DMV which isn't enlign with USCIS as far as immigrants are concern. If you enter the country as student and work premit like H1B your good ...you dont have a problem with your license.

With k1 we entered the country temporary and the only reason why we stayed its because of our marriage. DMV isnt miniterial in function as far immigrants are concern so they would need to confirm from USCIS with our status.

The explanation of DMV was: EAD/AP card only permits you to work while GC permits you to stay in a definite period of time.

Proof of adjustment while pending doesn't mean that the GC will be approve. Once the GC is denied for whatever reason the EAD/AP will be cancelled.

I find the argument really logical and right. So I surrender...eventhough its still colder I really ate an ice cream to cool me down...hahahaha

Which state are you living in now? In my opinion their denial decision base on K1 visa is totally bulls***.

You have the EAD in hand, they definitely have to provide you the driver license.

A lot of people with variety of immigration statuses are using EAD to get their driver license. There is no any reason to deny your driver license application if you have EAD with you. Unless a final decision has been made for you AOS case, or their system hasn't updated your EAD status. But for me, the K1 visa is the reason for not giving you a driver license is totally BS.

I'm sorry but i'm feeling upset for you right now.
