So I got an email/text that our case was updated and got super excited only to see that we got an RFE! :( It said they sent out the letter the 26th. I have no idea what it is only that it said that it was for initial evidence. I hope it's something small like forgetting to fill in something. We went through the K1 process so fast (4 months) with no problems at all so this makes me nervous! I am really hoping that it doesn't have to do with the affidavit of support...last year I wasn't working due to a back injury so my 2013 tax transcript wasn't that great, but now I have a good job that meet the requirements (I sent an employee letter and pay stubs, along with child support evidence to show I now meet the requirements) This is frustrating!

K-1 Visa Process

04/08/14 - NOA 2

06/23/14 - Interview

01/12/15 - Received second email/text saying his EAD/AP card is being produced!

01/16/15 - Received email/text that EAD/AP card was mailed and was given tracking number

01/17/15 - EAD/AP card in hand!

01/29/15 - Received notification that our Interview has been scheduled for Mar. 3rd!

I'm sorry to read that :( I'm waiting for my RFE too and I have the same worries as you do (about affidavit of support). Let's hope it's just something small and easy fix and that it won't slow down our processes too much! I try to see it as a positive thing that at least they are working on our cases! But I'm nervous too...

Well I got my RFE in the mail today. Like I thought, it's about the affidavit of support. There are 2 things that they want:

- supporting tax documents for the most recent tax year. My husband didn't file taxes for the 2013 tax year because he was a student and unemployed. His income was 0 so he wasn't required to file. I included a statement in my AOS packet explaining why he didn't file.

- they're saying that my husband doesn't meet 125% of the poverty guideline. He has had a job since last May and he makes $27,040 as annual income, which is above the poverty guideline for a family of 2. I submitted all his paystubs he's had since he started working. They're asking me to submit evidence of assets that meet the standards (my husband doesn't have any) or obtain a joint sponsor.

My husband is going to call the Customer service center on Monday morning. I'm really bummed out right now cause we don't have anyone that could be my sponsor so that sucks really bad :(:(:(

His parents aren't making enough to be sponsors and he doesn't have any siblings and is not close from any other family members. We used a joint sponsor for the K-1 visa (it was the father of the host family I had when I was an au pair) but he's going through a divorce so it's not a good time. Besides I haven't talked to him in a while.

I don't understand cause I thought that it was the current situation that was important. Maybe he hasn't been working long enough. And the thing is a letter from the company is not listed as what they're asking me to submit. It's either evidence of assets or obtain a joint sponsor. Those are my only 2 options.

Oh I'm sorry Aurore! That's awful. Though my husband has a job now (was a student last year) we asked his dad to sponsor us just to be safe. Hopefully calling will help?

Why does everyone do the early walk-in biometrics by the way? Do you think it speeds up the process?

Also, I got here on the VWP and applied for AOS... am wondering, when should I apply for a SSN? After EAD? Or after the GC?

Thanks! Yes in this situation having a joint sponsor is always good, to be on the safe side. I hope that calling will help but I'm afraid that if we don't do exactly what they want on the RFE, they would deny my AOS. So I know that the best solution would be to find a joint sponsor.

About the early walk in, I don't think it really speeds up the process that much cause usually people just go a few days earlier than their appointment. But it can be convenient if you can't go on the day of the appointment (instead of rescheduling it). We did it because I read that the Atlanta office accepted early walk in and I wanted to be done with it :)

You can apply after EAD!

That seems so unfair that they would want the return, though, if he was a student last year and just started working!

Yes! He filed for taxes in 2012 and 2011 though (he also was a student at that time) so I hope it's not too late for him to file 2013 taxes. I just thought that he wasn't required since his income was 0. Anyway, I'm more worried about the joint sponsor situation. Didn't sleep well last night, kept thinking about it :unsure:

I am worried about the RFE too now. We didn't add tax returns for last year (he didn't file one, he was a student + no income). We added proof (enrolment letter) and explanation for the lack of the 2103 tax return. We do have a joint-sponsor...

Does that mean they won't care about the missing tax returns (because we have a joint-sponsor) or will they still want them regardless?

Yes it can be anyone as long as he/she is a USC or a LPR (they want proof).

Maybe you won't get a RFE since you have a joint sponsor. I really don't know. Apparently some people didn't get one so hopefully you won't! :)
