Good news that priority dates have moved forward again. My mother-in-laws (MiL) I-130 petition for her under 21 daughter, is once again current.

The big problem is:

I have discovered that there are 2 priority dates attached to her petition.

USCIS issued a 02DEC2013 date and forwarded the application on to NVC.

At some point while at NVC, the priority date was changed to 02DEC2012.

We had asked Senator Grassley to see if he could get the application expedited because my Sister-in-Law was going to age out at the end of May 2014, and his office was able to get this done for us. We were not told the request had been approved until it chanced to come up in a call to NVC so communication between us and NVC is/was and has never been the best.

The petition was approved and sent over to Manila.

While we were trying to set up an interview, the priority dates regressed, as we all know, and the application sat in Manila for the past few months.

While sitting there, I discovered this priority date anomaly.

I have called NVC about this and they said it was not a problem but I could call Manila if I wanted and see if it was a problem for them.

I am planning to do this tonight. I did call and schedule an interview and there was no problem seen or found at that time.

The major issue I am seeing is that MiL only arrived here mid November 2013 so a priority date of 02DEC2012 is before she ever arrived here!! She could not have filed the I-130 before she arrived!

Has anyone ever seen this type of thing before?

I did contact an attorney and the only advice I got was call NVC and Manila to confirm everything was all good to go.

Is it possible that the expedite request cause the date to change?

Any thoughts from anyone on this would be greatly appreciated!

-Phil

It is the mistake of NVC but your sister in law might get in trouble during the interview. If the Filipino screener and the consular officer ask her when did her mom arrive in the US which they usually ask, then there... They double check too all the documents even after the interview even if you're all good and were sent home without any 221g form (brother got delayed because of that and he got the papers they need during his interview, they just overlooked at it)..the passport/ green card copy of your mother in law will surely show that she wasn't here yet on Dec, 2012 and December 2013 is not yet current. You can only have your case be expedited if your pd is current. God bless and good luck to your sis in law's case. Please update us on what the Manila Us embassy will say about this.

I sent a letter to Manila and I await a reply.

NVC says its not an issue and don't worry about it.

I guess we will find out as the interview is scheduled for the 24th of this month.

Hi philandshir! So how did your sister in law interview go? What did the manila U.S. embassy say regarding the PD mistake that happened at NVC? So curious about it because this is definitely a very rare case.

God bless.

Sister-in-Law had her interview Wednesday and was told to go home and wait for her visa in about 10 days.

they kept her passport, only asked 5 questions, Do you have a new CENOMAR, whats your age, who filed for you, what does she do in the US and.... I forget the last one...

They did not require a new CENOMAR just wanted to know if she had one. She did not.

Now we wait 10 days and see what shows up in the post.

Anyone know how long it takes before https://ceac.state.gov/CEACStatTracker/Status.aspx updates?

I see that https://ceac.state.g...ker/Status.aspx shows ISSUED.

I know this simply means "We have authorized issuance of your visa", which is good.

I understand this means its not actually issued.

How do I discover what the "issuance date" is?

What other 'status' besides ISSUED could be displayed?

Thanks!

Yes that does mean actually issued, and that is the issued date.

It still needs to be printed, packaged and pickup by 2GO, but it has been issued.. just not delivered yet.

I do not agree... Just because they have authorized the visa to be issued does not mean its actually issued.

I view it like the IRS, just because they authorize a refund, it does not mean the check is cut.

Well the ISSUED date that will show on the visa is the date of that notice on CEAC, and yes it has been issued... just not delivered... you know... check is in the mail. ;)

I hope so. This has been a long battle for my wife and her family. Many heartbreaks and tears.

End of next week would be the delivery date then.

Will the status change again?

Like maybe 'In Transit' or 'Out For Delivery' and such?

For me it means the actual visa is issued (the sticker they put in your passport) and they are processing (cross checking the visa and the passport and the address to send it to) before it is delivered.

What other 'status' besides ISSUED could be displayed?

It could display REFUSED but I doubt you'd get/want that. For you, the last status is ISSUED.

I don't think the CEAC site shows "out for delivery", I think at that point the search will show blank.

USTRAVELDOCS site I believe will show in transit, delivered or such.

After issued USEM states it can be up to 10 days before delivered.

I was thinking maybe 'Administrative Review' could be one that could still happen...

ISSUED is before printing and packaging for delivery, so it can still be a couple days before it would be ready for 2GO to pickup and deliver.

I think only the USTRAVELDOCS site shows the finer details.
