If he is free and legally able to marry, I don't see why he would be denied. Did he want to include the child as K2?

i'm assuming he is the biological father of the child. He should first get the birth certificate amended and get his name included in it.

Then proceed with the K2 process.

Like salmuf said, assuming he is the biological father:

Of course there are risks of K2 petition denial since the birth certificate is the main proof that the child is his to begin with. Have them fix the birth certificate/separate registration certificate first, then process the K2.
