Timeline

My mom LPR file petition for me this Sept. 2, 2014 under F2A. I'm from Philippines. I'm 20 turning 21 this Feb. 2, 2015 so basically my birtdate is Feb. 2, 1994. My question is am I still eligible under CSPA?

Visa Bulletin as of Sept. 2014 is: 01JAN13

You will be eligible if your actual age minus ( day the petition was approved - day on NOA1 ) makes you under 21. I 130's have taken a long time and the current priority date means that people are waiting 18 months for a visa number . So in 18 months you will be almost 23 . It is hard to tell if you will make the cut off. The priority date could move forward or backward in that time.

This will not be over quickly. You will not enjoy this.

April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

If your petition takes a long time to be able to be approved at USCIS, it will be an advantage for you because you'll have a longer allowance for CSPA. With your age and the current priority date plus if the movement is 5-6 weeks like before, you might be transferred to fb2 when your files reach NVC which will take an extra of about 8 yrs of waiting...unless the priority date jumps to current or very close to the current date then you'll get a better chance. Whether CSPA will benefit you or not depends on when USCIS approves the I-130 and how long after it takes for your PD to be current in the F2a category.

Without knowing the I-130 approval date, it is irresponsible to say "you are still eligible don't worry" because you can still age out and CSPA will not help.

The I-130 can be approved in a month or a year.

There is no way to know.
