If it is just the 2 of you, then correct.

I have a question:

So my mom in law is the co sponsor. She is a retired nurse and she filed tax jointly with my dad in law. Both of them are retired already. Mom in law will file i864 and dad in law will file i864a, right?

Qestion:

On part 6 of my mom in law's i864, will she put her annual individual gross income there from her pension? what if she has any other sources of income declared on her income tax aside from her pension? would it be okay if she will just enter there her gross income from pension as long as it exceeds the income requirement?

Yes, she files an I-864 and her husband provides an I-864A to go with her I-864.

If she earns more income than just the pension, then why only list the pension income? Put her total current individual income from all sources combined together. Provide documents that prove all the incomes.

I was actually thinking about putting all her total individual income. But I am having a difficult time figuring out how it doesn't match the total gross income stated on their jointly filed ITR. She has a W2 which is from her part time job, 1099 R from her pension monthly ans 1099 misc from Assisted Living Professionals LLC. I don't understand those forms. If I add them, it doesn't match the total gross income on their ITR.

Pls help!

The current annual income does not have to match the income from her last tax return. She files jointly too, so it won't match anyway. Her income is combined with her husband's on their joint taxes. Just take all her incomes and combine them. Use that amount and provide all the documents you just listed, plus perhaps some pay stubs and pension benefits letter to prove the incomes. It also can help to provide bank statements to show how much income is deposited each month, especially if any of the income is non-taxable.

I am going to sponsor my daughter but don't have enough income so my son will be co sponsoring.

My son and I live in same house and we are not dependent of each other.

I know I have to file I 864 as petitioner.

What about my son...should he file I 864 or I 864a?

he can file either. if he needs to combine income with you, then he needs to file the i864A, if not, he can choose to file the i864

or he can file the i864A as your household member.

Hi everyone!

 

I'm struggling to complete out I-864! I'd really appreciate some help :) We're applying for AOS for a K-1 visa. We've just returned from abroad, so my husband (the petitioner) has virtually no income right now and he's currently looking for a job. We are living with his parents at the moment and using our savings. He will complete I-864 and his mum will be my joint sponsor, also completing a separate I-864. She earns more than enough to meet the requirements, but does her husband need to file I-864A because they file jointly? Or is it unnecessary as she already meets the requirements? Also I'm unsure about part 5. Should my husband's household size be 2 (him and me) and his mum's be 3 (her, me and her husband)?

I believe you don't have to add the I-864A, seeing as the main co-sponsor earns enough money. The I-864A is used to combine finances, which is not needed in this case.

 

As for household size, the USC, doesn't factor in the co-sponsor's household, only the alien spouse (plus whoever is in the co-sponsor's household) - so yes, 3 sounds right. For the main sponsor's I-864, you will count the both of you.
