a little background check so i can explain it easier... came in the US in july 2011, got married august 2011, applied and gor my conditional GC in dec.2011, renewed it and got thenew

GC in Dec 2013, now we had our third year aniversarry and we just called USCIS to ask when can i apply for naturalization. One lady said i hgave to wait till December and another guy said i can apply 90 days prior -- meaning end of September 2014.

So can anyone help me because they gave me two different answers.

USCIS Early Filing Calculator

The information in this part ONLY relates to your time as a permanent resident if you file under Section 319(a) and 316(a) of the INA. All other eligibility requirements MUST be met at the time of filing.

You may file Form N-400 ninety (90) calendar days before you complete your permanent residence requirement if your eligibility for naturalization is based upon being a:

  • Permanent resident for at least 5 years; or
  • Permanent resident for at least 3 years if you are married to a US citizen.

To determine your 90-day early filing date, begin by identifying your 5-year or 3-year date as a permanent resident. For example, if the date on your Permanent Resident Card says “July 4, 2006,” you meet the 5 year permanent resident requirement on “July 4, 2011.” If you have met all other eligibility requirements, you may file your completed Form N-400 90 days before “July 4, 2011.” The earliest date you may apply for naturalization would be “April 5, 2011.”

The calculator will help you verify that you file your Form N-400 with USCIS no more than 90 days prior to your permanent resident anniversary date. USCIS will deny your Form N-400 if you file your Form N-400 more than 90 days prior to your anniversary date.

09/06/2013 - File for Removal of Conditions
10/01/2013 - Biometrics for ROC
02/03/2014 - Card production email received

02/17/2014 - 2nd card production email received

02/28/2014 - 10 year Green card received

90 days prior to your 3-year residency anniversary but not sooner than 3rd anniversary of your wedding.

So you can file early but at the time of filing you have to be married for 3 years. I am in a place when I have to wait for 3rd wedding anniversary event though my early filing window already opened (got GC in Aug'11 as well).

woow, that calculator thing is awesome, i feel stupid that i have never seen it before. Thank you both so much! My 3 year permanent resident aniversary is in December 25, 2014 so it says i can apply after September 25, 2014 :-) i alredy meet the 3 year wedding aniversarry ( August 2014) so .... im so excited!!!!! :-) Thank you so much!!!

I wish everyone an easy journey .... we sure have been through a lot of paperwork and stress with the process,all of us, time to get some relief :-)

Good luck. My window opens in a few days too but I think I will wait until I get to the five year mark as it requires less paperwork.

i still havent send it, i plan on doing it tomorrow. Just to be sure im over the frame with a week or r

two. What is wuityh tghe five year mark??? i know nothing about it to bd honest. Im trying to do this soon as possible becaude im tired of all this docvumentation and appointments...im ready to bevome a us citizen :-)
