Hello everybody,

I'm an approved GC Holder via my wife petition and plan to get my US Citizen (USC) in early 2015. I have had a good and stable job for 03 years. Once I become USC, I want to petition for my parents and 02 other siblings and their families (each with wife and 02 less-than-10-year-old kids) at the same time. I have a few questions:

1) Regarding the process, I will need to file only ONE I-130 for my parents together and ONE I-130 for each of my sibling families, totally TWO I-130 for the 02 sibling families. Is my understanding correct?

2) Is that okay to petition my parents and my 02 sibling's families at the same time? Is that so many petitions at a time? Do we need to prove the financial condition/income to petition multiple families? I am rush to file for my siblings because of the on-going US immigrant reform which will abandon petitioning US Citizen siblings.

I appreciate much if there's any input.

2. You can petition your siblings and family. You do realize it is at the least going to be about 10 years at best. Just to give you a time line.Yes

1) No. Each of your parents will require their own separate I-130 since you will be petitioning them as an immediate relative, which do not allow for derivative beneficiaries.

When it comes to your siblings, you can petition them but it will be around a twelve-and-a-half year wait for their priority dates to become current and for them to be eligible for further processing, as siblings are the lowest priority in the family-based US immigration system. You would file one I-130 for each sibling, and each sibling's spouse and minor children would be able to immigrate down the line. Note that their children may age out if they turn 21 before receiving a visa; it would depend upon the exact waiting period and their ages as to whether the CSPA would protect them or not.

2) You can sponsor as many relatives as you wish, but need to file an I-864 affidavit of support for each principal family member that is immigrating, and as the numbers you sponsor increase, so do the financial sponsorship requirements.

You will only file the I-864 for your parents once their I-130s have been approved and you are dealing with the NVC; the same for your siblings but that interaction will be over a decade away in their case.

You can read this year's requirements here: http://www.uscis.gov/sites/default/files/files/form/i-864p.pdf but be aware they change yearly in accordance with the poverty guidelines issued by the Department of Health and Human Services. If you are a member of the US armed forces then would use the 100% guidelines; in all other cases you would use the 125% figure.

You would accommodate your own family's household size, and would then include the alien you are sponsoring. If, for example, you were married and had two children, then your own household size would be 4, so with the alien would be 5, and assuming you weren't in the armed forces would need to demonstrate an income of $34,887 for one parent, and then $39,962 for your second parent.

I am going to file for my parents and sibblings too in the begining of 2015 as I am in the process of N400.

As per my understandings, Parents petition would be approved first while siblings petition still would be in waiting list. How could we file I-864 for sibbilings later? How much time would it take for us to file I-864 for siblings? Could you please explain it? Thanks

Well since your dealings with the NVC for your siblings' cases will be a long way off, you won't be filing those I-864s for years.

Hi

I am also planning to file the petition for my parents and my brother. As the process for sibling going to take more than a decade, I am thinking to file for my brother first. For both the petitions, USCIS site asks to file Form I 130 only. Just to clear my doubts, I need advice from you guys:

1. Do I, my parents and brother have to file G325A (Biographic Information) as well?

2. Filing I 130: Please let me know in which part I am right or wrong?

a. For my parents: File two I130s (1 for mother and 1 for father).

When their case will be approved from USCIS, they have to file two DS 230 (!?) (1 from mother and 1 from father).

I have to file only one I-864 for the parents.

b. For my brother: File one I130 (for my brother, sister-in-law and nephew). In Form I130, Part C from #1 to #16 includes information about my brother.

On # 17. (I am confuse in this part) Should I write:

Brother's name-----------------Relationship: Brother----------DOB------------Country

Sister-in-law's name----------Relationship: Sister-in-law----DOB------------Country

Nephew's name---------------Relationship: Nephew----------DOB------------Country

OR

It says husband/wife and children of your relatives:

Also, in Part C # 10. Alien Reg. Number - my brother once visited US in visit visa. so, should I write the number of his visa in this section or leave it as N/A?
