A petitioner have submitted a K1 petition with girl A which was denied at visa interview for ground of no genuine relationship and has not respond to NOID. After few years, filed another K1 petition to girl B, petition was approved, (former petition to girl A was noted in the application), approved petition expired since april 19 but girl B was able to get a visa interview scheduled first week of Sept. my question is, would girl B's visa application be affected for not responding to NOID letter of the petitioner? Petitioner did not actually proposed but girl B made him do it in tears before leaving on the first and last visit. I just want to know your thoughts?

To get the semantics out of the way first, the petitioner would have receive an NOIR letter (the R standing for revoke) and the petitioner would have revealed the prior relationship in a new petition, not an application.

It's unlikely person B's visa application may not be affected by the petitioner not responding to an NOIR in regards to the petition for person A. The petition that was filed on behalf of person A would have been revoked based on the failure to respond.

It's not often USCIS sends NOIR letters on returned K1 petitions, they usually allow them to expire and then tell the petitioner to start over at square 1.

Petitioner did not actually proposed but girl B made him do it in tears before leaving on the first and last visit. I just want to know your thoughts?

This is another issue altogether.

Well, the petitioner wasn't really sure about proposing yet to fiancee B, we kept asking him the whole he was visiting with her whether he would propose or not and he said, he wasn't sure of the whole idea as it has been too quick.. they have been talking for a year before their first meeting (that was 2 years ago). so 3 days before the petitioner leave to US, girl B asks him if he is ever going to propose to her and started crying, they were in their bedroom, so the guy, just gave him a ring laying down on the bed, saying, here's the ring… lol… afterwards, girl B came out of the room beaming and flashing her ring. petitioner had no choice that time, I guess?

Girl B I hope is up to date about Girl A. I am sure it will come up. Not answering a NOID/NOIR, RFE all that is a ref flag so be ready.

Op- the NOIR in itself won't cause problems, but make sure that girl B knows everything that went on there, including the name of girl A etc, because she may get asked at interview.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
