US citizen with fiance and kids to apply for B2 visa. Help?

Hi guys! I just have a question, I am a 24 year old US Citizen who is born and raised in the Philippines. I got my citizenship when I was 16 from my American father. I have 2 kids (aged 2 and 3 mos) also born in the Philippines and my fiance is with us too. The kids don't qualify for the report of birth abroad since I wasn't able to live in the US for 1 year continuously. We would like to visit my relatives next year, would it be possible for them to file a b2 visa? I can file for a k1 visa for my fiance or petition my kids but I am not living in the US and I don't think I can prove my financial capability since I don't have a job in the US. Would their chances of getting denied be high? What would our options be? Thank you so much for your response!!

The option is to apply for a B Visa or not apply for a B visa.

It is not a chance based process overall.

Wow, what a helpful response, all knowing one. Was that meant to be in any way helpful to the questioner or just to show your cleverness and general snootiness?

The purpose of the website is for people to ask questions and get help. What the person is asking is if they would qualify for such a visa. If you don't know the answer, be quiet.

Of course Nothing I say should in any way be construed as a breach of VJ TOS. If you misread it that way, read again and do not put any spin on it. Even your signoff says "jerk". But don't misread that.

I see you ignored the question.

If you are going to take the time to post why not add your detailed knowledge?

Ranchomama,

You wrote, "...would it be possible for them to file a b2 visa?"

I'm guessing that it's possible for anyone to apply for a B1/B2 visa. I'm not aware of any situation, circumstance, or otherwise

where one isn't allowed to apply. Being approved or denied is a separate issue as to whether it's possible for them to apply.

One thing that's for certain though is that you'll never know if they'll be approved or denied unless you apply for the visa's.

As I'm sure you're aware, the cost would be $160 USD for each child. I'm sure someone will/can correct me if I've provided

you with incorrect information...limited as it is.

Good luck and a desired outcome.

Regards

I believe that the only people who can not are US Citizens, which makes sense.

Many people seem to confuse apply and obtain, which is another subject and the only way of finding out for certain is to apply.

Yup, yup...pretty much goes without saying...non-US citizens.

Double thumbs up for sentence two. IMO, buck sixty a person is peanuts compared to the overall cost of obtaining

other visas.

OP,

Yes it is possible for your wife and kids to apply for b1/b2 visa. There is no restriction against applying. You don't need to file it for them as non immigrant visas are not generally petitioned.

Getting approval depends on many factors. But chances of getting rejected is very high as she has very strong ties to you, and you are USC, hence your family might be trying to have an easy way into the US instead of going through consular processing ( not my thought, but it's a general assumption that any US visa holder is a potential immigrant). In your case your family is most definitely future immigrant, so good luck convincing the CO that your family just wants to visit and come back.

I think, if you do intend to immigrate, you might have your best chance going to the US a little early, finding a job, and applying for the K-1 visa and derivatives for your family. You'd be apart for several months, but it's the best way to get approved.

Otherwise, as you've heard from others, I think the B visas are a gamble.
