AOS at "Interview scheduling and testing" stage for 3 months

Timeline

I am asking for advice guys, I came on K1 visa and i married within 90 days, i received my work permit and the advanced parole.

When i checked on uscis website, it says my GC application is Interview scheduling and testing it has been in this state for now 3 months and i have never received any notice of any kind about that stage i have called them a number of times and they keep on reading what the website says. I wondering whats going with my application?

Am i safe? Advise guys

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Call USCIS again and request to be transferred to a tier (level) 2 agent who should be able to provide you with the updated info regarding your application! Good luck to you :)

We are in the same boat. We have been in interview and testing for 5 months. I called our lawyer and they opened an inquiry. The inquiry came back and said they were still processing. Depending on your local office you could be in this step for up to 9 months or so. So, hang in there. Check the processing times for your local office. If you are past their times then open a tier 2 case... otherwise, you are just wasting your time.

Certain areas are probably more backlogged than others. It is pretty much a case of waiting, or trying to get in touch with the USCIS CS. And higher if you can. Try your congressman too.

depends on your local USCIS office. for example i'm from socal which has a horrendously big backlog (but apparently not the worst?) and my case was in testing & interview for like 4 months. waiting is hard but there is an end to it, good luck :)

My wife and I have been in that specific stage for about seven months (it's been eight months since our priority date, and nearly six months since she receive the EAD). I believe you have to wait much longer before you can escalate the case, since three months doesn't sound very long.

Just keep checking the USCIS processing times for your local field office in the meantime to get an idea of what priority dates they are working on currently.

It suggests that it would be about six months before they get to your case, and from there it can take a few weeks to actually get scheduled.

Six months from when they recievrd it? Coz it was transfered from misouri and from when i filed its already six months now. How does the congressman assist?

Let's do the math.

You filed in April 2014. As of July 31st (the latest date they've provided data from), they are working on cases from December 19th, 2013. That is a difference of 224 days. And now there are 67 days between today's date, October 6th, and the date of data reporting, July 31st. So presumably, at the current rate they have a caseload of a total of 291 (224+67) days based on the current rate.

So add 291 days to your AoS date (by the way, fill in your timeline!). Let's say you filed in mid-April. Add 291 days to April 15th, and you get January 31st, 2015. That's actually under four months from now before your case enters the scheduling queue at your local field office. From there, it may be a week or two (possibly more) before you get scheduled and sent an interview notice letter.

These are rough guidelines and each case is unique. Hope that helps.

I too have Portland. I filed AOS March 17th. Our initial interview was October 2 but we had to reschedule as my husband was away on business travel. Our rescheduled interview is October 29. It took almost 6 months from the date we filed to get our initial interview date. Sadly we are going through a slower office. Upside there are slower.

Did u adjust through k1 ? Wat is the interview like wat am i supposed to prepare is it that hard like the k1 visa at the embassy? Wat does portland office need to have in order to pass the interview?

Yes my husband did come to the US on a K1. You will receive a letter once your interview is scheduled with everything you need to bring. For the most part you will need to prove you are in a bona-fide marriage by showing proof of commingling.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
