Greetings,

My wife filed a petition for me as a LPR of USA. On 3rd Aug'14, She paid AOS fee and on 5th Aug she received cover page via email. But till now she didn't receive any instruction from NVC to submit AOS documents.

1. Should we wait untill getting NVC instructions before submitting documents?

2. She is not eligible to sponsor me as she is not doing anything there. Her maternal uncle wants to sponsor me for my case. He is an American citizen. Is there any obligation taking a sponsor from a person who is not my petitioner or even blood related?

3. In my case, which form will be best suited, I 864 or I 864A? and what additional documents need to submit with AOS form?

Note : Till now, it is showing "N/A" for the AOS documents in the summary page of my case in the webpage - ceac.state.gov

1. If you have cover sheet just send them right away as now it takes roughly 60 days so use the time wisely

2.Yes He can be join sponsor

3.Even you wife earns 0 income she will still need to fill I-864 ( even 0$ ) and your Uncle will fill I-864A ( If you wife lives with him , i mean if she is your uncle's household member) or I-864 ( If she lives elsewhere )

Go and look at I-864P for min. income for particular household sizes
