Hi, everyone!

Do anybody knows what to do if USCIS does not approve you after almost 5 years marriage.

Here some explanation: we have pending case (family based)over 4,5 years. Recently we had another interview. IO sleeted us and questioned separately. Attorney presented. I have been questioned 2 hours and 20 min. My husband -US citizen -- about 40min. No decision yet.

PS Can it be a problem if someone has 2 DL from different states?

Your case has not been pending 4.5 years. It has been long, but it has not even been 4 years yet. Last thread you said it was 5 years. I am not sure why you lie to the people you want help from.

You need to make an infopass appointment today. Contact your US representative on Tuesday and ask them for assistance.

There is no way it takes 31/2 years to get a green card if your case is as straightforward as you are making it sound.

I would request, prior to firing the attorney, a copy of your entire file. Once you have that fire them and request a refund. If they refuse to refund at least some of the $10.000 you say you paid them I would file a complaint with the bar association. That is a lot of money to pay and not have a green card.

OP, let's go reaaaallly slow over this.

What happened after your 1st interview? What did your lawyer tell you was happening after your 1st interview?

There had to have been something come up after that 1st interview. Your lawyer should have been calling the USCIS daily to get an answer as to why there was no update with your case. If your lawyer hasn't given you a clear answer as to the problem, that means he/she is robbing you of money (scamming you)

YOU need to make an info pass appointment and find out what is going on. YOU need to contact your US representative and have their immigration person find out what is going on. YOU need to fire your attorney and request a refund. What you are describing is unbelievable and ridiculous. You have paid your attorney $10,000 and still don't have a green card in over 4 years. YOU need to find out what the problem is.

You have been giving all the advice we can give you. It is up to YOU to do what is needed to get your green card.

OP: fire your lawyer! Most of us here had no lawyers, and did all the paperwork ourselves, the only things we paid for was what USCIS was asking for and got our AOS approved between 2-4 months! If you really have a straight case, nothing to hide, fire your lawyer, talk to a Tier 2 rep. at USCIS and get up on your feet, and do it yourself and you'll have your green card in had no time. However, if it's a super complicated case that you don't want to share, then nothing we can help here, and this thread should be closed. Good luck with whatever you do!
