No it is pre tax earnings. If the co sponsor has anyone else in their house who is considered as a dependant on their tax return then it will increase yet again.

sorry if this is going to sound silly but it's better to be safe than sorry...so...if my fiance makes, let's say, 25 thousand every year but after taxes it's less....he can be a sponsor for 3 people?

If you make at least 125% of the poverty guidelines, then you should not need a co-sponsor. If they accept your income as good, they will not accept the co-sponsor information from you because they won't need it.

Yes, the poverty level guidelines change every year.

Gross income, before taxes. So, you can take what they make an hour times how many hours they work a week. Then multiply that weekly pay by 52 weeks to get their current annual income. For example, if you make $15 an hour and work 40 hours a week, then you make $600 weekly. That makes the current annual income $31,200. List your current income and then use a letter from the employer and/or recent pay stubs to prove that amount. If he makes $25,000 before any taxes are removed, then that is what you list, and it is enough for a household size of 3. http://www.uscis.gov/sites/default/files/files/form/i-864p.pdf

Thank you so much, that is all very helpful information. I will try and get my mother to send me a copy of her I-134 (I'm in Serbia at the moment) and we'll see what happens. I plan on calling the Embassy again on Monday and asking what I can/can't do. Thanks again.

Monday is holiday.

When you have you mom send the 134, needs to be original signature. Depending on when you interview date is, you mihgt have several days to have the form in your hands.

Most important: don't panic

As others have noted, bring the 134 and the 864. They will look at the overall picture and earning potential -which depends on the CO actually.

IN some consulates, if you have something missing, you can provide later.

I have no direct knowledge of the consulate you are going, and you might want to post specific questions of what seems to be most cirtical i nthe Serbia page.

I134 is essential for a K1 visa. Ask your mom to send it to you but make sure she couriers you the original signed copy in legible ink, printouts/faxed copies are not accepted.

Regarding the poverty requirement, if your mom has already listed you as a dependent in her tax returns, then they would be considering it a family of 3. The criteria for poverty requirement is actually 100%, however you will soon be filing for her AOS and that requires 125% so many of the Consular officers consider a 125% requirement during the K1 step itself.

Thank you very much. My mother is working on the I-134 now and will DHL it to me here in Serbia ASAP (Unfortunately it will cost $125 to send. yikes!) She did not claim me as a dependent last year, but has in years before. It don't think it should make much of a difference though, considering she makes just under $200,000/year. Right now I am just hoping they will accept her as a co-sponsor period. From what I read on Visa Journey's consulate reviews, it seems to be pretty relaxed there, but I could not find any information whatsoever of them accepting or not accepting co-sponsors. I will call Tuesday and ask, and let everyone know after. Thanks you, and everyone, again. Once again Visa Journey has saved me from a mental breakdown!

So.... I called the embassy again yesterday and asked if they accepted co-sponsors for the i-134 and got a very strange answer. The man basically told me that the i-134 for a K-1 visa actually has nothing to do with finances, but he couldn't tell me what it was really for. He said to me just to fill it out, and sign it and furthermore, he specifically told me NOT to bring any evidence of my income (i.e. Tax returns or bank statements). Then I told him "Ok. Just to clarify, I don't make 100% of the poverty level, and I don't want my fiance to get denied because of it." He interrupted me and said "Look, you're not listening to me. That form has nothing to do with money, but we still need it. Just fill it out and bring it."

Very strange.
