No HE is the one to cancel HIS visa. Not her. She was responsible for her petition. It has been approved and the visa has been issued, therefore HE should cancel it with the embassy and SHE can notify USCIS of their decision not to use the visa. As I said numerous times future petitions by her or future applications by him can cause problems. She is responsible for the petition and he is for the application! Both can contact the said entities. She can tell USCIS she will no longer go through with the marriage. She can not cancel HIS visa. They can stop him at the border and deny entry if she red flags her approved petition. Likely this will not happen. It takes a long time for all agencies to act on it.

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Do you want to be with a person who takes your life not seriously at all? I mean you are together for three years, you both went through the trouble of filing for K1, you quit your job, bought a ticket already for crying out loud! And she gets a cold feet now?? I am sorry, but she sounds very immature.

Probably the best bet for you is to start looking for a job in your country again and forget the whole thing.

I am not sure about "love" when her action speaks a very different tune than her words. May be she is not the marrying kind.

yes i dont want to come and this isnt a visa fraud .. just wanted to know if she can cancel it or not ? or if i have to do it?

She can't "cancel", but she can advise USCIS/DOS that she is not longer interested in the relationship, which could trigger your denial of entry upon flying in (notice the 'could'; USCIS and DOS are not the faster peopl ein the world). She would've done by now I'd think.

Keep in mind that you might still be able to fly in, but find yourself nowhere to go upon arrival.

if she is not sure what to do , leave her , i don't know why some they advice you to visit herto talk to her , 30 minute on Skype is enough for both of you to know exactly what to do, why you spend your money to talk and go back later to your home ,this is crazy

I can relate to getting 'cold feet' at the last minute....Before I started our K-1 process, I planned to meet her in Kaula Lumpur, Malaysia and travel to Malacca for a three week holiday. For some reason, or lask of, I panicked :jest: and cancelled after paying for my flight and 1/2 the cost of a house rental....lost $$$$

Four months later...the after panic subsided, I jumped on a plane and gave her an engagement ring in person (F) She'll be on a flight the US in 5 days visa in hand... :yes:

I think you need to think about why and what, your both fighting about, and deal with honestly. Failing that, you have a hard decision to make. Showing up on her doorstep without a agreed arrangement ....could get ugly

We cant really say to him he must go see her, or not..... We don't know about their relationship.... only thing I could say is wait a couple months to cancel. If you cancel it already and in a month you two make things work it would be sad to start all over or what kind of process it would be.... and too much stress to handles again.

( I don't mean you wait a few months to see what she says, just wait to cancel )

You have 6 months to travel on that visa. If you fly in to the US in a couple of weeks that same visa will not be valid once you enter here so I would suggest that you make use of Skype and have a talk with her. At least you will have some time to discuss very well.

Just wait out the six month period and let it expire. It cannot be cancelled before that.

Or you may visit her and try to work things and if they still don't work, leave the US within three months.

Just make sure you both know that if you let the visa expire this time and if you wish to get it again in the future you will have to provide solid proof as to why you did not get married when the visa was issued.

Cold feet before a wedding, and then still getting married, happens all the time. The question is why she has cold feet. 30 minutes on Skype is not enough time to resolve some differences. Some things have to be resolved face to face. He already spent the money on the ticket....that ship has sailed. If there is a chance to fix it, I think he should.

Entering the US on a K1 doesn't constitute visa fraud. He can legally stay in the country for 89 days if things don't work out before returning home. OP you have resigned from work already because of this process. Go ahead and visit if you have the required funds and see if things can be rectified before closing the chapter on this person.

I totally disagree. The petitioner has made it clear that there is going to be no marriage. Therefore entering the country on a K-1 visa would constitute fraud. A K-1 visa is issued for the sole purposes of marriage within 90 days. Not really to "rectify things." I would suggest the OP stay in their own country and start looking for a new mate.

You can disagree all you want, but if he enters the country in order to convince his fiancee to change her mind and go forth with the wedding, he will have broken zero laws. If he fails and returns home there is still no law broken. Fraud would occur if he had no intent what so ever to marry, or never did in the first place.

She has made it clear to him that she has no intent of marrying him. Think that counts? And remember, HE knows this. I believe both parties have to agree they are getting married within 90 days (letters of intent to marry). She has changed her mind. Fiance visa are not issued for persons to enter the US to convince someone to marry them. With all due respect, you are wrong.
