CAN I CANCEL MY FAINCE ISSUED K1 VISA?

HI GUYS

MY FIANCEE AND I HAVE BEEN FIGHTING LATELY SHE SAYS SHE HAS BEEN FEELING THIS IS NOT RIGHT ANYMORE TO GO THRU WITH OUR MARRIAGE PLANS EVEN THOU THE VISA HAS BEEN ISSUED LIKE 2 MONTHS AGO AND AFTER I HAVE RESIGNED FROM MY WORK ALREADY BOUGHT MY TICKET LIKE 1 MONTH AGO ALL WHICH SHE KNEW.

SHE MENTIONED ABOUT CANCELLING THE VISA AND WOULD LIKE TO KNOW IF IS POSSIBLE TO DO THAT?

If you come in on K1 with no intention of getting married to that person within 90 days then it's visa fraud anyway. I assume you're the beneficiary. So if she does not want to marry you there is no point in coming.

I am so sorry to hear you are having these problems. :( Someone else who has actually done a K-1 visa can better answer (I'm doing a CR-1 instead) but I believe she can cancel it by contacting USCIS. If you don't get married you won't be able to follow through with the next steps to legally move here. The visa is only valid for a limited time, during which you need to arrive and marry within 90 days. In addition if you do NOT arrive within 6 months I believe it automatically expires. Again, someone who has done a K-1 needs to correct me if I'm wrong here.

My suggestion though, since you have already purchased the ticket, talk to her and see if she is willing to delay the cancellation and allow you to fly there and speak in person, talk through the issues face to face and THEN make a decision. You are in a difficult spot right now but IMO if you love her and she still loves you, it's worth a chance. Long distance relationships aren't easy and an in person discussion may be what is needed to save the relationship. If you can resolve you are here legally and can marry and stay. If it is not resolved, you will have to go back to your home country.

EDIT: I see someone else said it's immigration fraud if you come without intent to marry. I would say to that you ARE coming with intent to marry, even if it doesn't happen, so not sure that's fraud. Can someone else respond?

thanks much , yes we have being talking she tells me she really loves me, am the only person who makes her happy and she still wants me in her life forver and i should not think she does not cos of this but its just that we have been fighting more and she feels is not the right time anymore... i do love her no matter what we have been together for 3 years now . my flight is in 2 weeks now cos i had to change it to go save my relationship cos the distance is killing us but she is still saying she feels the same way of us not going thru with this now my visa expires in november ...am just so confused now !!!!!

It sounds like a case of bride's cold feet, which is fairly common when wedding date comes close. Hoping for the best for you.

Am so sorry this is happening to your relationship. I don't have experience with K1 visa process and I don't have knowledge about K1 visa cancelation but my advise is that you should reshedule your flight and get on the plane to save your relationship. I know what it feels like to be seperated from loved one, am speaking from experience because some times I feel like ending this process myself because the distant is so frustrating. Go and meet your sweetheart and try to solve everything face to face, if she doesn't want to push thru with the relationship and wedding, then you should return back to your country.

You don't need to do anything. Just let it expired that usually takes up to 6 months. Sorry to hear that happened to both of you. Wish you all the best.

The petitioner cannot cancel a K-1 visa that has been issued. In fact the petitioner can do nothing to stop things once the I-129F petition has been approved other than refuse to cooperate with the rest of the process.

Because the K1 is only valid when the person holding it has a fiancé that intends on marrying in 90 days She could contact and say she no longer intends to marry and they will refuse to let you in the US. The visa is already in your passport I assume so she can't remove it but she can get your visa annotated in the system. If that happens you will be expected to go home from the airport without being admitted to the US. A huge waste of at least 10 hours of flying. If you just got the visa I would work on things for a few months and take it from there. It would be a big mistake to move and then not have a viable life here.

This will not be over quickly. You will not enjoy this.

OP, I agree with those that said you should come to the US to save your relationship. However, that is if, & only if, she is OK with that. I mean she may not feel that this is the right time to marry. But you didn't say that she doesn't wanna continue the relationship. I think if you come, you will have time to iron out your issues & still marry within the 90 days. Just see if she's OK with that.

Just remember that if you enter the country, you have to be married within 90 days or the visa is no longer valid. If things don't work out and you leave the US, but reconcile with your fiancee later, you won't be able to come back on that visa; you'll need to start the process over again, and you might find it more difficult to get an approval the 2nd time around.
