Hello everyone! I hope this note finds you well! :)

I just have a few questions, I'm a 24-year old woman who is a US citizen. I would like to file for a k1 visa for my fiance, we are currently both in the Philippines with our 2 kids. How do I establish my financial capability? Also do i have to be in the US to file? Or is or alright that I am in the PI? Do i also need to file for a letter of support? Or would my fiance's bank account statements be enough? Thank you guys very much!!

You can file from the Philippines, assuming that you have all the necessary documentation and can send it to the US via a courier service. You do not prove the ability to financially support your fiancé until the embassy interview stage, which comes later. But when you get to that step, you will have to show you make 1.25x the Federal Poverty Guideline for a household size of four (US income, not foreign income). If you cannot do so, you will need a co-sponsor, which becomes tricky in the case of the Philippines (I'm sure someone else will comment on this). You cannot use your fiance's assets to meet this requirement.

In most cases, a family member or friend would be fine. However, I've read that the US Embassy in the Philippines sometimes does not accept co-sponsors. You should wait for more replies or try researching in the appropriate regional forum on this website for more information.

The funds for the petition fees must be in US funds drawn on a US bank.

There are several instructions and guides that you should become familiar:

:guides: easily accessible at the top of the forum page. In particular, the K1 visa guide: http://www.visajourney.com/content/k1guide

Good luck on your visa journey.

Hi everyone! I just have a few questions with regards to filing the K1 visa.

I am the petitioner and I'm currently in the Philippines after giving birth 3 mos ago. My questions are:

A. Can I provide an income tax return from the Philippines?

B. i am currently staying at home since I just gave birth and my fiance is the one working. He earns a little above what is in the poverty line, would that be valid?

C. Even i I am the woman would I still need to be the one to provide support? Even in my fiance's earnings are okay?

Thank you very much in advance!
