Hi yes i have a problem , me and my wife got married within 90 days august last year and when i filed my taxes ( turbo tax) it wouldent let me put her ss#down for some reason so i filed single and now trying to do AOS got a RFE about my taxes and income are we gonna get denied because of that and lose our $1070 im not sure on what to do or what i should have done could someone please help us ? Thank you

Why not amend your tax immediately and send them the new copy with explanation?

Besides, your married filing status and her added as dependent should total lesser tax

and you might get back some money.

That's very strange that it only let you file single.You would not have been able to efile your taxes if your spouse did not have a ss number however it should have allowed you to print it and mail it.You have to mail in returns where a spouse does not have a social security number,I used H& R Block software and the software informed me of how I had to file. Anyways you should look into filing an amended return asap.

Feb 6th 2013 - Response that my case was tranferred to the local Jacksonville field office on Nov 19th 2012
Apr 2nd 2013 - Infopass. Found out that there was an RFE dated Dec 19th that I never received.USCIS website never reflected that either.Got a copy of the RFE .Time to make another infopass to drop documents off at local Jacksonville office.

Apr 29th 2013- Dropped off RFE documents at local office

May 7th 2013- Got text that petition was approved.

You have to paper file the first year with a new SSN. You lost around 3K by filing single instead of married. You can amend your taxes, file a 1040X.

For tax purposes, a dependent is a qualifying child or a qualifying relative, but never a spouse. You may claim an exemption for a spouse when filing joint return and, under certain circumstances, when filing a separate return.

I had the same issue with Turbo Tax.

I researched and learned I couldn't file "single" if I was married.

I also learned that I had to paper file and not e-file.

I also learned that my foreign spouse, who does not yet live in the US, needed an ITIN number (since he has no SSN) to put on the tax return in order to file.

With his passport, I filed the W-7 and within 60 days, got his ITIN number, placed it on my return, mailed my return, got his passport back and my transcript online.

For the OP, I would amend the return and change as Married.

Interesting... We filed our first joint return together electronically (TurboTax) without a problem with my wife's new SSN. Of course, she received it in January 2011 and we filed in Feb. or March of 2012, so at least 13 months had passed for them to have it in the system.

OP - file an amended return, as married, ASAP. Show proof of filing the amended return until they process it and you can get the tax transcript and, hopefully, a sizeable refund for the change in marital status!

For the documents, the one it goes with 1040x & W_7, does it have to be original?The reason im asking because I road on the w_7 instructions that certified copies are fine.
