My fiance came here on a J-1 visa last year and he already has a social security number. He went back to the Philippines now. We are doing a K-1 Visa right now. I'm wondering if he has to apply again or not once he is back in the USA again. Also, can he work right away or he has to have the approval of form I-765 first before working? Please let me know. Thank you :)

A SSN is yours for life. So he should use that number. As a K-1 visa holder he will not be able to work until he receives is Employment Authorization Document (EAD) or his green card (GC). After getting married, he will file the I-485 adjustment of status (AOS) and should also file the I-765 for the EAD and I-131 for advance parole (AP) so he can begin working and if needed leave the US and be allowed re-entry with the AP. The I-765 and I-131 are included in the $1070 I-485 fee (for one person adjusting today). Being able to work boils down to the I-9 form his employer would need to complete.

Good luck,

Dave

(organizer hat off)

To answer the second half of your inquiry, to work in the US he will need to have in his possession a valid Employment Authorization Document (EAD) from the USDHS.

Good luck on your immigration journey.
