Anyone have luck with no joint sponsor??

Hey Guys!

My wife and I are currently in the process of filling out the Affidavit of Support; however, I have never filed taxes before. I am currently living in Denmark and just accepted a job which will require me moving back to the states (which is why we are applying for this). I now have a job contract and everything but no taxes to show the past 3 years. I know that I supposed to have a joint sponsor since I can't show taxes. But I was wondering....has anyone ever tried filing the AOS with no joint sponsor and not having taxes?

I was thinking about writing a letter and explaining my situation that I now have a good paying job, my wife is college educated and already in contact with some companies. What do you guys think? Ever heard of anyone being able to do this?

You need a joint sponsor because you have no current income or appropriate assets, not because you haven't filed taxes, which you need to do anyhow. USC must file taxes wherever they live in the world if they make over the threshold to file.

No your spouse will not get the visa without a qualified sponsor.

A job offer is not enough; as mentioned above, you need either current income or assets- we filed on assets alone because my husband also lives with me abroad, so that may be an option. The other potential possibility, if you are willing to live apart for a while, is you going to the US now and starting the job, that way you have paystubs to show.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thanks for the replies! I need to clarify: I started the job a couple of months ago so I do have income now and do have invoices that I can show. Do you think that would help? :)

Tremendously! Do you make over the poverty guidelines? If so then get on filing those last 3 years of back taxes and don't forget the 2555 form to exclude foreign income.

Yes I make over the poverty guidlines. But if I just start a couple of months ago, why do I need to file 3 years of back taxes? In Denmark, I was doing a unpaid internship so I didn't need to pay taxes then. And back when I lived in the states I only had summer jobs in between college but I was considered a dependent so my parents paid the taxes on that.

Did you, at any point, make over the threshold to file in the USA while you were in Denmark? If not, then you do not need to file taxes. You will need to write a letter and submit the proof from the IRS website stating why you didn't need to file your taxes. On the I-864 you will write "not required to file" for the 2011, 2012, and 2013 taxes.
