My husband is a Canadian citizen and is currently visiting me in the US. He told border patrol he was only going to be staying with me for 2 weeks, but now that he has gotten here we are thinking maybe he should stay for a few months. By then I would have my passport and I could fly back to Canada with him and await his interview date from Cr-1 process. Is it okay to stay longer than you told border patrol you would be? Is it okay to stay for months at a time when you are undergoing Cr-1 Visa process? He has a plane ticket to leave to go back to Canada for 6:23 this morning. We would like to cancel it but we are scared there are consequences. Please help.

For starters, He didn't speak with the Border Patrol, he spoke with an officer from Customs and Border Protection (CBP).

Once he was done with the entry procedures, how long did the CBP officer authorize his stay? He may have told the officer 2 weeks but the officer may have granted him more time than that (perhaps up to 6 months).

Staying on past the intended time is not a problem as long as he departs before his authorized stay ends.

Alright, sorry. The officer didn't specify. He was in a hurry because my husbands plane was leaving. His stamp on his passport says Feb 7th, 2015(which is 6 months from the day he entered) but it's in the spot where usually it states the date he was admitted. I am wondering if it was just a mistake. Thank you for answering.

He can stay without any problem until Feb 14,2015.

Sometimes CBP will stamp a date exactly how long you will give them at the POE/border. but in this case, the CBP gave him until Feb 2015 instead . So he is good to stay until Feb 2015.
