Problem with SSN - Need to get EAD first?

Hello,

I went to the Social Security Office in St George yesterday with all required paperwork. The woman told me that she could not process my request until I got my EAD. She said they used to be able to issue SSN for K-1 with just the I-94 but it is no longer the case. I am just worried that I will have to wait for a couple of months before having a SSN and to pay for private insurance in the meantime (as I cannot be added to my husband's policy without a SSN). Is anyone in the same situation? Thank you

A K-1 is entitled to a social security card and number (for a woman, in her maiden name only) without an EAD if you have at least 14 days of validity left on your I-94, whether or not you have married yet.

If you met these requirements then the worker you spoke to was wrong; this happens all the time. You should go back, armed with a copy of https://secure.ssa.gov/apps10/poms.nsf/lnx/0110211530 and ask to speak to a supervisor if necessary. I speak from personal experience when I say the SSA is staffed by mouth-breathing morons.

What original documents do I need?

Immigration status

To prove your U.S. immigration status, you must show us your current U.S. immigration document, such as Form I-551 (Lawful Permanent Resident Card, Machine Readable Immigrant Visa) with your unexpired foreign passport, I-766 (Employment Authorization Document, EAD, work permit) or I-94 (Arrival/Departure Record) or admission stamp in the unexpired foreign passport. If you are an F-1 or M-1 student, you also must show us your I-20 (Certificate of Eligibility for Nonimmigrant Student Status). If you are a J-1 or J-2 exchange visitor, you must show us your DS-2019 (Certificate of Eligibility for Exchange Visitor Status).
