This may be a silly newbie question but it seems that most of the K-1 visa people had their first meeting in a foreign country. Can your first meeting take place here in the US? Originally we were going to just meet in the Philippines in January but I came into some extra money from the sale of a car and am paying for her to come here for two months. Can we file with this meeting or should we wait to file when I go this January?

Yes you can, just make sure you take pictures together of you in the US (best if they're time stamped on the camera), you hold onto her boarding pass for entering the country, copies of her stamped passport, and get as much evidence of your time together. We took pictures of us in front of restaurants and saved the receipts, a copy of the vacation rental with his name on it (hotel's would work too), etc.

Most important both of you have met in person within 2 years regardless which country you have chosen. The reason why not many people did in the US because too difficult to get B-2 visa especially from the third world countries. I applied B-2 visa back in 2010 and denied. We did not meet in my country due restriction of military and chose Singapore as a neutral country to meet in 2011.

Initial meeting can be anywhere. You guys just need to provide proof of meeting in at least once within 2 years before filing the I-129f. If she's coming over to US, do include her US visa, passport stamp and boarding pass to document this meeting.

Providing she has an active visitor visa, and can enter the country, you can start gathering the paperwork to file once you meet the requirements.

She'll actually be staying at my place so hotel receipts wouldn't exist unless we took a weekend trip. Which would be very doable if that would help.

Also she'll be coming Oct 8 through Dec 10. Could we start filing while she's still here?

Yes, of course you can as long as you have all documents are needed. Also it is much easier since she does not have to send G-325A, letter intent of marry, and photo passport through snail mail. Good luck!

I visited my bf then, now my fiance (he proposed while I was in AZ) last Mar-May. Took a long unpaid vacation. Took tons of pics like the famous Grand canyon and submitted it as proof. Never put passport stamps or boarding passes and was only itinerary. It was approved with no RFE.

But I tell you, the tourist visa is so hard to get though. I am just lucky since I have a previous visa so maybe it has bearing for my tourist visa approval. The pretty young ladies who were interviewed before me were mostly denied. Reason? No strong ties to go back to the country.

AOS Journey:

March 30 - AOS/EAD/AP sent

April 2 - USCIS received

April 9 - NOA1

May 6 - Biometrics

May 7 - Case is ready for interview

May 21 - Request for EAD expedite

May 26 - contact congressman for EAD expedite

June 1 - EAD card in production

June 2 - EAD approved

June 6 - EAD/AP combo card received

If she already possesses a tourist visa no issue. But do not plan on your fiancee coming to the USA on a tourist visa, it is extremely difficult to get a tourist visa in the Philippines.

If she does not already have a tourist visa - you best plan on a "road trip" (ok it's over water but YOU will need to do the traveling)
