It says it is returning to the United States with a recommendation that it is revoked , your case will remain pending under section 221g of the immigration and nationality act while it is returned to the NVC fir their review

That's what his said

He asked and they didn't tell him y

And it's been only 3 weeks now but my petition says valid till sept 28 that's the end of this month

But I also see where it's good for a year from the day he did his visa and that was on June I have read that online I have been searching since this all happened but I haven't gotten anything and I am the petitioner

So I don't no I'm confused

What do I do any ideas

On the 221g something was checked you aren't denied because of 221g. So ask your fiance' what was checked on the form.

  1. Also want were the questions?
  2. Was their a certain focus of questioning?
  3. How many times have you visited your Fiance' before and during the process?
  4. For how long?
  5. When was the last time you saw each other?
  6. what red flags do you Have?

All these factors play into your approval or denial?

What have you done so far? Have you contacted your senator/Congressman? Have you contacted the embassy and requested that you fly in and meet them and present?

This is a K1 with very little time and once your petition leaves he embassy and comes back you have to decide your next move. Go get married and file a I-130 or wait and let our petition expire (which they will more than likely do).

Your petition will be purposely expired by USCIS and it will not be re validated.

You will receive a letter from USCIS in about 6 months saying you can file another petition.

You don't have to wait for this letter and can marry and file a CR1 rather than a K1.

It will NOT be reviewed.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

For your answers he wasn't asked nothing but I see you want to go to the United States , and he said yes to marry my fiancé , my fiancé had all the proof with him

And nothing was really asked to him he didn't do a sit down interview they asked for his passport and gave back asked for our bank statements and his police report and clearances and doctors envelope and they told him to sit down and wait and then they called his name and they wanted to see his pictures nothing more then. Pictures she looked through and gave back and then he sat down again and was then handed a letter

It has been one year now since I seen him and I stayed there 3 weeks

What congressman do I contact and how do I do that

I emailed his embassy they said nothing they can do it is out of there hands and on the the visa center so I did write a letter and mailed it too the national visa center for a extension last week and told them how every thing went , how do I write or contact the congressman like u all say ? His or the petitioners ? And how ?

You have had your interview , there is no need for extension in the minds of immigration. They auto extend when their interviews are backed up so that it isn't expired at the interview. They did take the pictures and documents so some sort of conversation went on between them. Something is missing in this tale. You can wait but the denial for expiration is going to come. You can go back there marry and go the CR1 route or refile a new K1 at any time ( assuming it hasn't been more than 2 years since you last met ) The second K1 will usually force them to pull the first K1 and send and RFE if your second petition doesn't overcome the issues with the first. A CR1 won't do that because it is a different visa class but has the advantage of not expiring so if you get denied a second time you will get reviewed at some point of time. It is rare for second petitions to be denied unless there is some real reason for denial ( not the gut feeling of the CO but something funny going on )

This will not be over quickly. You will not enjoy this.

There is nothing a senator can do at this point because the case has left the embassy. A letter to NVC will do absolutely nothing.

NVC just routes your case back to the service center where it will expire.

This is the end and you have to file again and pay the fees again.

Time to let it go and focus on visiting and either re filing a K1 or marrying and filing a CR1 (which doesn't expire should you be refused in the future).

Yours is not an unusual situations, happens all the time.

we hired a agent and our case is bring worked on it goes for another 4 months it cont on when a letter is pending ok it wasnt denied ok

thats why we went through a agent i thought this site would help me but there is so many people that are negative.

What is your problem ?

Your petition is expired and I don't care what your "agent" is saying, he is clueless and just eats your money and wastes your time.

Don't come here talking about people being negative when they are telling you the hard truth that you chose not to listen to.

Do you really prefer a lie over the truth because it makes you feel better ?

Your petition is expired. Case closed. End of story. Listen or learn it the hard and expensive way.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
