Hello Everyone!

First of all thank you to everyone who posts here, you have helped so much!

I have my entire AOS packet ready to send, except the I-693 form. I have found that the appointment could be two weeks at the earliest. I am Canadian, and have been in the US on a vistors visa and am nearing overstay. I am married to an American, came through inspected, am on his health insurance, lease, and just gave birth to our first child two weeks ago. I am getting very anxious and want to mail my forms ASAP!

On the USCIS website it says:

If you are applying for adjustment of status, you may submit Form I-693 in one of the following ways:

  • Submit Form I-693 by mail, together with your Form I-485, Application to Register for Permanent Residence or Adjust Status, to the location specified for your Form I-485 (see “Direct Filing Addresses for Form I-485”).
  • Submit Form I-693 by mail, after filing your Form I-485, to the location specified in your most recent communication with USCIS (for example, a Request for Evidence letter from USCIS).
  • Submit Form I-693 in person, at an interview in a USCIS field office (if an interview is required).

You can file it after you mail in your package, or bring it to your interview. Has anyone done this? Or should I just wait and risk the overstay by a few days? I am paranoid that someone will show up in my driveway and take me back to Canada, it might be ridiculous but I am sure everyone feels some anxiety when filing these forms.

I would include it with your AOS package. I haven't read here anyone just bringing it to their interview.

But, you just had a baby, and for your bonding and recovery you certainly don't need the stress of feeling like someone will come to remove you. I would do whatever helps you be less stressed. For what it's worth, you will be fine, no one will come to remove you if you wait a few days.

Oh, I had plans to submit my package right before my baby was born, but he came a month early, So I ended up waiting a while to submit the paperwork until I was fully recovered. But, I wasn't nearing any overstay deadline.
