Yes you have to interview, be refused, be eligible for the waiver, then file the waiver.

Lawyer sent in our RFE response today. Also contacted my congressman. A caseworker is going to be assigned to review and should contact us next week. I hope whoever it is is up for a challenge! I faxed over 12 pages and that's only part of it. lol Didn't want to overwhelm them. :help:

Squad1986,you keep saying June 11,but you not saying if you did anything, you can try an inquire .I am July got an inquire in last week, but i still feel like contacting our Congress man. Lioness did you have to ask your lawyer if you can contact your Congress man or you did this on your own. I am scared i might have to stop working, because i am getting real sick, I need this surgery, but i am a little afraid to keep contacting USCIS ,because my case is a CIMT,simple things on his record 23yrs ago,but they say appovals is by discretion. What you guys thing? Is it better to sit and wait and do nothing.

souad1986 i am sorry that you have no news yet on your application, you could call immigration and have them inquiry about your application. Also can be done online, but sometimes is best to talk to someone that may have access to more information.

I am really looking forward to any good news on your applications, please keep us post it.
