Well just as I feared Andrew's memorial refuse to let my fiancé in today for his medical that the USCIS asked for. The embassy is insisting that he needs a waiver the USCIS is stating that he doesn't and the two are continuing to argue over it. Meanwhile Andrew's memorial refuses to let them in to complete the medical exam that the USCIS asked for in the RFE. So we are at a standstill. my fiancé is now stuck between the two facilities in Kingston. Our lawyer has issued a mandemus. This is the biggest mess I have ever heard of! How is it that the embassy can refuse to listen to the USCIS. Nebraska service center??

First priority on what? I don't know about any types of priorities, you submit your waiver and you wait the time they take to process the form.

I am so sorry to hear this and that is happening to you as well, this happened to me and its very frustrating. We ended up sending waiver even though USCIS told us my issue could be resolved by US embassy given the fact that they were the ones that didn't send documents to the correct place. I am really sorry to hear this is happening and I do hope your issue gets resolve very soon without having to send waiver.

Everyone has gone to an interview to be to the point of needing a waiver. You are in line like everyone else.

Hello do you know if now they are reviewing AUG 16 and mine is JULY what must I do ?

The date on the website is misleading since they don't process cases in exact order received. Not always there issue ... some cases are more complex, some expedited and some just take longer to get info from the embassy. They are not close to be done with July yet.

Hi everyone. Just need help understanding the waiver process. Initially and before sending my case to the NVC, my lawyer said I needed to complete a waiver( simple over stay) and file it. But fast forward 3 months later, my case with the NVC is completed and I have an interview date but I don't have a waiver. He is saying that, I don't need to file it until the officer interviewing me at the consulate asks for it. So my question is, is this correct? Like can't I file it and have it ready incase they ask for it? Or if I file it in advance it will ruin my chances if it gets denied? Please let me. My interview date is April 28th so I am freaking out a bit.

Thanks

You can't file waiver until you have been denied.

Thanks, but what do you mean "til I have been denied" like at the embassy (consulate) after the interview?

Thanks

You can't file waiver until you have been denied.

Yes you have to interview, be refused, be eligible for the waiver, then file the waiver.
