Timeline

When I asked my lawyer to request an expedite, the lawyer called the USCIS a week later and said that the expedite was denied. My husband and I called the USCIS Because we just were tired of the lawyers cr@p. The USCIS told us the expedite request was not denied and that they sent a notice requesting the expedite request be submitted in writing. So I had to go back to the lawyer and beg thenm to send the request in writing along with my written explanation and evidence. It took a week for the lawyer to fax the info to the USCIS. After that, we didn't hear anything for the longest time about a month so we called on October 29th. The USCIS told us that the expedite request was approved on October 15th. It took 2 months from the expedite approval to get the waiver approval. We got the senator's office involved. Our original expedite request was called in September 5th. I suggest you call on your own and bypass the lawyer. Your expedite request might be approved. The senator's office can find out if your file has been assigned to an officer. Good luck

Does the seator office cobtact you directly or your attorney?? How long does it take to here something from them

You contact the senator's office and ask them to make an inquiry. Usually within a week they will get back to you. Not your lawyer, unless you request that they contact the lawyer. You'll have to scan back a release so the senator's office can make an inquiry. Our senator's office made an inquiry once a week for us and they were able to get very specific information. It is so much better than trying to pry info from the USCIS...

Timeline

Question does my fiance get the letter from embassy or will it come to me,our 601 waiver was approved March 11th, an any idea how long till he gets visa?

In our case, it came in an email to both of us. Probably because I was the one who talked to the consulate most of the time. There were things on the instruction letter that I had to address. The timeframe varies depending on the consulate. The consulate won't start processing until they have verification from the USCIS. That could take a few weeks or a month. Our embassy told us to contact them when I know we are approved so they could contact the NSC and get the approval verification. Your embassy might not do that. They may prefer to wait for the USCIS to do their thing. My husband entered the US a month after the waiver was approved. It would have been much sooner if it weren't for the 2 week shut down during Christmas. All consulates have their own process. Good luck and keep us posted.

Timeline

Will it go to NVC before embassy, can I contact NVC to see if it's there yet.Our embassy is New Delhi India. When we filed the 601 waiver I could not get any information because i was not the patienor he was. Can I get information now or not?

No, NVC is out of this. It goes to the embassy. Actually, the embassy already has the file from when you had your interview. They have everything they need...they just need the verification of the 601 approval. They may ask for a new medical and police report and maybe the 2014 w2s.. but the file is already at the embassy. Call the embassy and ask if they received the approval verification.

Hello everyone! I'm new here. My fiance applied for a k1 visa for me, we got approved but I got a call back due to a past visa application made on my behalf at 15. We were asked to file a waiver for misrepresentation. We mailed the waiver to Phoenix lockbox March 13th 2015(i know, still fresh off the bus) from what I've read here the wait time is something else(preparing my mind towards that) but my fiance was told he would have to file 2 waivers due to the fact that the k1 is both an immigrant and non-immigrant visa. Did anyone else hear this? Or go through something like this? After the time in Phoenix lockbox what's next? Thank you all and I wish everyone victory in the process of reuniting with our loved ones. Congratulations to all who are already reunited :)

This is the email We got from New Delhi embassy. We have received your application for an immigrant visa. Unfortunately, your file is incomplete; therefore your visa application has been refused under Section 221(g) of the Immigration and Nationality Act (INA). Further consideration will be given to your visa application after you obtain and submit the documents listed below: they need PC and PCC and Medical an Passport.

I have a question....... when doing my taxes do i have to put my husband as a dependent at since he's still in mexico or do i not add him???

How did you file last year? And if you already went through he NVC and are now in the waiver stage, you may or may no be asked to submit your 2014 taxes if your waiver is approved before April 1th.
