It’s kind of. For example you have 2 Cr cases. Both were filled in December of 2017, December 15 and December 20. Went to same processing center. Uscis will make decision on December 15 first and after for December 20.

so in this case I guess you can call it calendar order.

I don’t need a lecture what priority date means. I’m trying to understand if uscis when they process the waiver keeping your initial filing date for I-130 as a  reference point. Because that what lawyer said. If you don’t understand what I’m trying to ask just ignore the post pls.

No. We couldn’t get an interview date there for long time and we moved our case to Almaty. Got the date here. Very small consulate. Just literally one room.

I have had interview in moscow. But anyway I think our situations are kinda similar. I was refused because of overstay. Our priority date for i-130 was January 2017, interview was in March 2018, we applied for the waiver in July and still wait like everybody else. I don't think PD for I-130 will somehow help to speed up a waiver process. Did they tell you for how many years you are baned now?

10 years.

3 different lawyers said the same timeframe. It’s also somehow depends on a country. They are saying if you would be in Mexico. It would have take 2 years for waiver.

I also have sheet with 601 waiver timelines and there you can find 5 and 4 and 8 months of approval. 

Official USCIS website are saying 90% of waivers getting ruled in 6 months.

 

so I’m a bit confused.

An I-130's Priority Date (and I-130 filing date...these are very different things) has no impact on I-601 adjudication. PD is only used for determining when a visa number is available. Filing date only applies to the form being filed.

I-601s are generally processed in the order received, although there are various circumstances  - just like an I-130 - that result in them not being processed in any sort of exact order. Some I-601s from Dec. could be processed sooner than an I-601 from Nov. depending on the individual IO handling the case, if supervisor review is needed, if any sort of investigation is needed to verify documents or facts, etc.

If it 12-16 months, how records of 5 months approval exist? It’s not just speed of curtain person, not just 1 month difference.

There are many people going through the process reporting their wait times on VJ

 

A year of so is normal, some are a bit quicker some longer.

 

Have you seen the waiver that will be submitted, slightly concerned about all this misinformation you have been given.

That's realy confusing. USCIS says "We generally process cases in the order we receive them" . At summer waiting time was 14,5-18 months, now it's 12-16 month.
