Your I-601a was filed and approved, you have gone for the interview and the embassy has denied you and told your reason for denial and what to file to overcome it....

You have filed I-601 in accordance to the denial to overcome your inadmissibility....

 

I think you should just wait for the waiver to be completed.......

I610 & i601 a are essentially the same except that the 601a can only be done while your in the states before you leave the country. 601 can only be done after you've been rejected. There's another form i-212.which is similar to i601. Sometimes they're submitted together sometimes just one is needed

Hi,  you are on the right track and just have to be patient.

 

To my understanding when you get deported or just filing as a new applicant with no prior issues, your I-130 will be approved as long as all documents presented are valid and true. Then you move to next stage which is NVC....

 

At NVC you will be scheduled for an interview at the embassy in your country of residence. At the interview is when the ban will come up and you will be asked to prove your case. If found inadmissible and denied the immigrant visa during the interview, that is when you can ask for the reason/s for the denial and what waiver you need to file  to overcome your inadmissibility before you leave the interviewer. 

 

Most likely you will be asked to file I-601 if denied the immigrant visa but i think you should not worry about it now and just wait for your initial immigrant interview to know the outcome.

Yes he can file the 212h in conjunction with his I-601 to overcome his inadmissibility. My take is for him to ask his lawyer to reach out to USCIS and ask if he should file the 212h in conjunction with his current filing or just wait it out.

Do you have the i601 or i601A approved? I601A should be good for the deportation and 5 yr ban. But why was you deported if you don't mind me asking. Most likely you will need the i601. For any criminal conviction..

Yes correct we filed the i601 waiver already and the wait starts again.  Would I have to do a 2nd interview?

@Pberry06 yes lawyer said we only need the i601.. he stated that he doesn't see me beening denied the i601 since the i601(A) was approve and I'm married and have 1 us child

I was deported because the officer said I wanted to work with my B1 B2 and also prior before the last visit I was in the stars for 5months but I never over stayed no criminal record

Depending of what the embassy finds after the I601 is approved, your second interview will be either to just drop off your passport for visa process to complete or you may be asked to submit more documents for further consideration. 

 

Remember the U.S embassy is kind of independent and try to do a much thorough review of the person coming for an interview than the case by case basis application of USCIS.

What you just stated here is what you will be asked to defend and prove that you were deported wrongly.

 

Start gathering...

-Your flight ticket for that travel and Itinerary showing your intended departure date from U.S.

-Stamp on your passport / I-94 on arrival to the U.S which will show how long you were permitted to stay in the U.S for that particular visit and should show you have not overstayed at the time of arrest and deportation.

-Affidavits of family/friends you were staying with while in the U.S indicating reason for your visit and what you were doing in the states during your visit. 

-You may also write a personal affidavit statement explaining what you were doing all through your stay using timelines and what you were doing when you were arrested and all that took place after the arrest until you landed Nigeria.

 

What you may need are these and many other documents and statements, these decisions are sometimes discretionary....

@Franco007 ok thank you really suck that they choice and add more work to be done. Maybe they would make me do the fingerprint and medical exam again. What do you think?

Biometrics i am not sure but medicals i think if it is past one year from your last medicals you will have to do it again because that was what my spouse was told at the embassy during her first interview.

Hi there! 

My visa was denied due to fraud and willing missrepresentation, in jan 11th

I have to file an I 601 and we found a lawyer... its super expensive so we think we’ll do it in the next month or april. I am in mexico and my husband in NY. 

I know its gonna take us a year and a half to be together aftef we file. Any one here from Mexico who’s dealing o dealt with the same problem who can give me an insight on the process? Can the visa still be debied after waiver aproval? Im really scared and i have very bad anxiety attacks every day. Just very upset. 

Please if anyone has some good information about the process let me know.

@Beatriz and Luis  Hi I also going Thur the same. I had my interview 9/07/2017. (México cuidad juarez).. I was refused/denied my visa also.  I filed for my i601 already and got my Congress person involved also. Spoke to a lawyer and said that helps.  Waiting for respond back from Congress person. Hopefully by Tuesday.. 

I was denied because I had 1 misdemeanor for recieving stolen goods. But I had my i601A approved before coming. Did you have your i601A approved? When I filed USCIS said I only needed my i601(A) waiver. Mexico said otherwise.(that’s what the my lawyer told me) From what my lawyer told me i601 waiver process is 4-6 months to get an answer.  I’m currently in Michoacán waiting for an answer. It’s been almost 6 months now, my mistake was not filing the i601 waiver back in September. I suggest you get it done ASAP.  

 

Did you file file with a lawyer or on your own?

are you going to file with a lawyer?

 

i recommend speaking with a lawyer because there a lot that plays to get an i601 approved..
