Hi everyone i am new here and i really need some help if anyone experienced d same. My husband received a decision letter on sep 17 for my i-601

Thank you for filing Form I-601, Application for Waiver for Grounds of Inadmissibility with USCIS on Nov 9 2015

After thorough review, uscis mist inform you that we are closing your application as explained below.

On April 30, 2015 the us embassy/consulate in manila informed uscis that you were found inadmissible under INA section 212(a)(9)(A)(i) which requires the form i-212 Application for Permission to Reapply for Admission in the united states after deportation or removal. Consequently, USCIS has terminated all actions in this case and notified the consulate.

Ic you have any questions about visa issuance, please contact the us consulate in manila

What does it mean? I have called uscis but they cant give me any answer and tier 2 call back isnt an option as i am not in d us. I called and went to the embassy but they cant give me any info and asked me to send an email which i did but they asked me to send form i-212 which is already received by uscis on july 29 2016 in response for request of evidence. Uscis site status is still d same so not sure what to do now and where to go. Please help. Thank u!

When was your priority date for submitting the I601? and when was his first medical exam? Im trying to understand the timeline of how this will happen and if we should expect a request for second medical exam (hence the additional expense of another trip to Juarez). My husband had his first medical 7/20/16, with a reciept date at the Nebraska Service Center of the I601 on 7/28/16.... And if I understand this correctly, you received the request for the second medical before receiveing any "approval/denial" on the I601? So you are still waiting to find out if the I601 was approved?

I am replying to your questions...Immigration received our 601 wavier on March 14, 2016...we are still waiting for it's approval as of 10/18/2016.

I will try to clear up some confusion I may have caused...my husband and I filed a 601A wavier first back in 2013 because my husband was living in the USA at the time. The 601A wavier was approved, and we received instructions saying my husband would need to keep 3 appointments: a biological (to take fingerprints and such), a medical exam and complete an interview at the Consulate in Ciudad Juarez. When you receive approval (and I hope you do soon) the papers will tell you when you are expected to be in Juarez...they suggest arriving no later than 1 day before you are due an appointment. The biological and medical do not have a set appointment time, just a date to appear...these must be completed I think it was 3 days before the Consular interview.

The first time we went to Juarez we spent a complete week there...if I remember correctly the fingerprints were first, and a day or so later was the medical exam. Now here is were it got tricky. My husband's 601A wavier was approved (this is not the same as the 601 wavier). We thought for sure that meant he was ok to come back home. The problem came during the medical exam. My husband had a DUI back in 2008 so they sent him to the psychiatrist for an additional exam to ask questions about drinking and drug use. My husband answered honestly that he continued to have a few beers here and there after the DUI, and had experimented with marijuana once and cocaine once as a teenager. The therapist asked if he drove home after having a few drinks...he replied yes. When he went to pick up his medical results to take with him to the interview he was given "blue papers". These "blue papers" informed us that he did not pass the medical, was considered a threat to US Citizens and their property, and had to stay in Mexico to return to Juarez a year later (because he continued to drink after the DUI and was drinking and driving - this is what we assume it was not stated that way in the papers). Someone on this website gave me a link to read about how Immigration defines an alcoholic or an addict...in that information it said Immigration considers someone an alcoholic or addict after using ONE TIME! A little absurd, but nevertheless their guidelines.

My husband had to stay in Mexico...where he remains today while we wait for approval of the 601 wavier (I filed with attorney after returning to USA in March). Because he failed the first medical exam he had to have a second exam...complete with another evaluation from the therapist. The "blue papers" told him he would need to return to Juarez a year later for the second exam.

I will say this from everything I have read and all the people I have spoke with going through this process...EACH CASE IS DIFFERENT. There seems to be no set rules...as you can see by the different answers everyone has received when they call the Consulate. We were told after my husband's second medical that we should receive a decision about the 601 wavier within 60 days (his second medical was in September...we are still waiting).

My suggestion would be to save as much money as possible because you never know which way things will go. Hopefully, you guys will go down to Juarez and pass everything the first time so you can be home together immediately. I pray that for everyone here. Just hang in there if you get the "blue papers". MrsCarr, I am not sure what the INA section 212(a)(9)(A)(I) says, but that is the reason he was denied. The letter is telling you he was denied, and that you must apply again with the I 212 form. It is best to ask you attorney for definition of the INA section codes and to advise how to proceed. Best wishes to you and your husband...you are in my prayers!

Jonando we already submitted i-212 and its for me not his it is basically just overstaying. I went to uscis office here in manila and they said the ban was lifted but i am not sure y the embassy dont know nothing about it when the letter clearly says they informed the consulate about it.

Ok, so I went back to check the previous messages and I stand corrected, it looks like what you are saying tends to be true as far as when people submitted vs get an answer. Gosh, our system is terrible, I was excited thinking I would maybe hear something in Jan...but if its true what you say about the dates, it wont be til March :( Thanks for sharing your info and keeping me in check, I need that sometimes, I feel like I am losing it over here. This wait time is ridiculous!

Based on some of the tracking being done by people in a Facebook group for the I-601, it looks like they're "stuck" processing late Jan/early Feb... and as of the last few weeks things have slowed to a snail's pace. Latest dates I've seen reported as approved without an expedite seems to be right at about Feb 5, and there have only been quite literally a couple of those.

Now we wait for the Consulate to receive the approval from USICS, and the letter that "gives instructions" (hopefully we won't have to go back to Juarez for another interview...fingers crossed). I will keep you all posted. Hang in there! I am praying for you and your families )

Has anyone processed there I-601 form on July 2016 and has received a response? As of today they are processing February 2016 but possibly some cases can be expedited quicker if "Extreme Hardship" can be proved. I usually call every two weeks, there is a myth if you are constantly calling that your case can be processed quicker. I honestly don't believe it but it doesn't hurt to try. The processing dates are updated from the 15th to the 18th of each month. So by now it looks like they are working month to month. Which basically means i will get my appointment by March or April of next year. Was hoping to be back by Christmas. Good luck to all!!!

We filed our 601 wavier in March 2016....but....we had filed a 601A wavier long before that which was approved also. Please see post above dated 18 October 2016 that way I don't repeat myself and waste space on the thread. If you have any other questions please feel free to ask :)

Expedite update today i received the 2nd letter of the same expedite i did 1 month ago but different letter 1st one received oct.4h, 2nd same letter dated oct.28. Explaining expedite under review,if no notice or response received in 15 days take as a denied and office estimated i601 process is 6 months. Why 2 letters same month different dates? Might they be still under review?

I wish they were averaging 6 months... we're over 8 right now, and the "on-time" cases that have been getting worked were received at least couple weeks ahead of ours. I still have at least 1 on the group I'm tracking from Jan 25th that hasn't been looked at yet.
