We expedited. Expedite was approved October 15th. It took 2 months to get our approval. That was not fast in my opinion.

I don't know if the expedite was approved I called but they will not give me any info they said the case is between uscis and my wife. I'm going to call the lawyer to have her call... Hopefully we can find out soon.. Quick question for lovemytico how long after the approval did the embassy contact you to setup an appointment?

Posted (edited)

Look at my spoiler. When I called the embassy on December. 23rd just to check, they gave me the appointment. Costa Rica is super easy to work with. Super nice and very professional.

Btw, if you have 3way calling, you can call USCIS and your wife and they will discuss the case with her on the phone. We did that many times.

LoveMyTico, did you receive any approval notice from mail?

no, because the petitioner doesn't receive a notice. Our lawyer received the notice a few days after it was approved but took his good ol' time sending it to me. I didn't get the lettr from him until January 2nd. We were approved on December 17th... smh

I keep telling my husband its a good thing I have VJ and I call the embassy. Otherwise we wouldn't be as far as we are if we relied on that lawyer.

The embassy told me last week I could email all the updated Affidavits and tax info ( even though they ALREADY have all the originals) My husband dropped everything off on Monday and they had everything from me and then at 5:30pm ( UGHHH) I got an email from the embassy asking for the AOS with ORIGINAL signature.. ( what the frig???) so I fedex'd the ORIGINAL AOS they wanted and it should get there today. Spoke to the embassy yesterday and they told me if they get everything by Thursday.... MAYBE just maybe, they can issue the visa on Friday but most likely Next week. Sooooo disappointing. They told me that everything gets sent to Washington and it usually takes 24 hours to get the go-ahead to issue the visa. I didn't know everything gets sent to Washington. I thought the embassy had all the power. Either way, we are waiting AGAIN.....

We just got our final interview appointment for 14 January. An approval letter was never sent out from USCIS, they just contacted the consulate directly. We are on a short timeline so the consulate is allowing us to pick up the visa on 15 January (providing the interview goes well). My stomach is in a knot waiting for all this!

Our CEAC status changed to READY this afternoon. They received the original signature packet I fedex'd Monday evening at around 9 am today. I was totally shocked to see the status updated... My nerves are shot too. Nobody should have to go through this .

My friend told me it will go from ready to AP to issued.... I hate being a stalker but I can't help it !!! Hopefully tomorrow it will update to issued and he can go pick it up by Friday. We are in a big hurry too. The embassy told me they are trying to get this done ASAP for us.

GOOD LUCK TO YOU. I am sure the interview will go well.

Hi guys, I'm new to this site.

I just wanted some of your opinions, we are currently waiting on our waivers approvals (601-212).

What would be for you a strong/approvable case?

Why did you or your husband/wife had to submit the waiver? (I was working as a babysitter under a tourist visa, no criminal records). Is this weird to ask? I would like to get an idea of our case and the position we are.

What do you think depends that the waiver process sometimes takes 3 months, some other times 6?

Thank you in advance!!!

I don't think the reason for the waiver matters as much as the hardship of the USC . You need a strong waiver with many hardships for the USC with evidence to back it all up. Did you do the waivers yourself or did you hire an attorney?

My husband only overstayed his B2 visa. He entered the US legally. No other issues. I had many MANY reasons for hardship and we even got our case expedited due to financial hardship.

Plan on an April approval give or take a few weeks. Follow the waiver groups on Facebook to get an idea of what to expect after the approval. Lots of applicants are from Mexico and know the process very well. I check my CEAC status often too.

So here is a plot twist in our whole waiver story...... Our congressman's office sent the Nevada Service Center an email asking for confirmation on the waiver approval and if it had been sent to the Consulate (making sure our interview on the 14th will be good to go). This is what the NVC responded with....

"USCIS records indicate that a letter was sent to the consulate in Frankfurt regarding this case and we are currently waiting for a response from the consulate. Once we receive a response from the consulate, your constituent’s case will be processed.
We hope this information is helpful to you. If we may be of further assistance, please let us know.
Thank you"
Our waiver was hugely based on the fact that the Consulate made an error in denying my wife a visa. She required a visa due to Crimes Involving Moral Turpitude. She only had one conviction(but 2 instances) on her record from when she was 16 years old (crime was committed at age 15 but she was sentenced at 16). Her sentence was community service and probation. She was age 30 when we applied for a visa, so technically 15 years had passed since the crime, no other crimes had been committed(not even a traffic violation), and there was only one conviction. They still denied her visa. This is just speculation but I am thinking that the USCIS got our waiver and said "hey wait a minute US Consulate, you majorly messed up in denying this woman so you better bring her in for another interview and give her the visa". That would make sense because according to the USCIS records the waiver was not technically approved but they are pushing the Consulate to continue the process. The Consulate has even told us that due to our time restrictions, they will allow us to pick up the visa after 24 hours IF the interview goes well. That to me says "Hey guys, we effed up and are trying reeeeally hard to accommodate you". Any thoughts on this from you all?
