Hi- My boyfriend has a ten year multiple entry visa. How long can he spend in the US per visit on this visa? If we do a trip to Canada, does this re-start the time limit? Can he apply for an educational visa while he is here on the B1/B2? Thanks for any help.

Hello,

With this visa you can visit for up to 6 months, he is not allowed to work. Please know B1/B2 is a visa to enter the country as a visitor and not to enter with the intention of moving in.

Also there is a good chance they will ask him how long he will be staying and what is the purpose of his visa, they have the right to deny entry if the suspect is not planning to go back to Canada. I currently have a b1/b2 visa and I am in the process of getting a fiancé visa to marry my handsome and amazing American guy, I have visited him numerous times, but just for a couple of days, they don't give me any trouble because I can show that I have a job in Mexico, etc.

The length of his stay will be determined by the CBP upon his entering the US and it will depend on how he does in his interview. In most cases, a B2 visa holder gets six months. [Presuming he is not Canadian], taking a short trip to Canada will not reset the clock, which means upon reentering the US he will still be bound by his original allowed date.

While he is here he can apply for a student visa if he satisfies the requirements of, and enrolls in an institution that is authorized by the USCIS to issue I-20.

It seems to me you're going the wrong way about getting him to stay in the US longer than a tourist should. If he has plans to study in the US he can - and should - get a student visa before arriving in the US to avoid any unpleasant surprises.
