Hello guys, I hope someone can help my fiancé though this is not a visa related. She just want to seek some advise about her case. She is from Philippines and got divorced. She received the final divorce decree from UK. She doesn't know of what to do next? Is she going to file a Petion of Divorce Recognition in Philippines? She's living out of the country and is difficult for her to find a lawyer. Where can we find a lawyer? Is there anyone here have the same situation with my fiance? Thank you so much for your help or advise.

My fiance is also from Philippines, he was married here and later they got divorced in US. I am also once married but got annulled in 2010..When I had my interview last August, his divorce decree and the original copy of my finality decision of my annulment are the documents I had submitted, the CO just looked at it and ask few questions only about my annulment..The consul didn't even questioned about his marriage in the Phils. and about his divorce.

I just don't know if later we will be having problems since divorce isn't recognized here in the Philip[pines and still his name w/ NSO for Cenmar/Cenomar still appears as MARRIED..if ever we need one for filing..

So you mean we can also apply for a K-1 visa using her divorce decree? In applying a K-1 visa she needs to submit a cenomar from NSO. What did you do guys? Did you submit his cenomar stating that he was previously marriage?

In our case, my husband did not submit NSO even if he was married here,since he was my petitioner and became USC by naturalization, all I had during my interview was his divorce decree..By the way,is your fiancee going to have her interview here in Manila? If so, NSO is needed since she is the beneficiary I am not sure cause it might reflect in her NSO that she is still married.

As a point of clarification. Annulments, as opposed to divorces, are only necessary for Philippine Citizens to get remarried in the Philippines. As such it is not necessary to have an annulment before petitioning someone who was divorced (outside the Philippines) via K-1. A member here, who is Filipina, got divorced here in the states, went back to the Philippines and was petitioned K-1 successfully. For a K-1 visa both parties must be free to get married in the U.S.. This does, however, lead to the rather odd thing that the new marriage is not recognized in the Philippines, and can even be considered 'bigamous' (if somebody wanted to take it thru the courts).

As an aside, as far as I know there has been no Philippine court test on what happens if a Filipino divorces in the U.S. (or elsewhere), then gets citizenship but files the retention of citizenship. So it is difficult to say what the legal status of a second marriage there would be.

Heres another one:

To "clear her marriage registry record," the Filipina must obtain copies (certified) of the Stateside divorce docs and get them accepted by the National Statistics Office. It can then become somewhat problematic, as she may have to have the action approved by a court or review of some sort...but not as difficult as her having to get an annulment.
