Thats great....

You might as well file for EAD and advanced Parole while you are at it. Should be free with I485.

Thank you, goodnight and may your gods go with you",

I131 form.

AdvancedParole re-entry permit.

If you leave the US for any reason before your AOS is completed you will be denied re-entry. If you need to leave the US for an emergency this should allow you to re-enter. I say should as it is not guaranteed.

If the I131 is approved your EAD card will also be your re-entry document.

Thank you, goodnight and may your gods go with you",

Ok thank you I didn't know about that one. I'm going to look at that now. I don't have planned leaving the states, main reason I stayed was to save money but we never know what may happen in the future, hopefully nothing bad. If it's free or not very expensive I may apply

So I won't be applying for the advance parole because while reading the instructions I saw it twice :

WARNING: DHS may revoke or terminate your Advance Parole Document at any time, including while you are outside the United States, in which event you may be unable to return to the United States unless you have a valid visa or other document that permits you to travel to the United States and seek admission.

And I also read this:

Travel Warning

Before you apply for an Advance Parole Document, read the following travel warning carefully.

For any kind of Advance Parole Document provided to you while you are in the United States:

(1) Leaving the United States, even with an Advance Parole Document, may impact your ability to return to the United States.

Since I'm a overstayed visa I think it would be too risky ( I don't have traveling plans soon anyways )

Advance Parole and Reentry permit are two different things. Those words are not interchangeable.

OP: Please apply for Advance Parole. It is free and you can use it to travel. You don't have to use it, but you will have it if there is an emergency. How long did you overstay?

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

I looked at I-131 form. That one is advance parole??? I'm confuse that one is the one that says that it's not sure you can be admitted in the country even with that.

Harpa My stay in the country with a visa waiver expired July 21st. My husband and I got engaged July 19 and next day Sunday 20 was my flight but I stayed.

We got married July 22.

Are you planning on never leaving the US unless/until you become a naturalized citizen? Because there is never any guarantee that you'll be admitted back into the US unless you're a citizen.

Yes, you want to apply for Advance Parole.

Overstay is no longer a bar to use Advance Parole; they recently changed the laws. Further, even before it was changed, one month overstay would not have prevented you from returning.

You are never guaranteed entry into the country, with the VWP, AP, a GC, etc. But, if you don't plan on becoming a criminal while you are abroad, then you will be let back in.
