It is a violation of the Terms of Service for Visa Journey to advocate or encourage any sort of visa fraud or misrepresentation. One post has been edited to remove such a violation and several others have also been edited to remove the quoted violation.

At this point you fall into the grey area of too married for K1 and not married enough for CR1. You need to marry and file cr1 as the K1 will be sent back and allowed to expire...

I APPLIED FOR A FIANCÉ VISA FEBRUARY 2. MY FIANCÉ HAD HIS INTERVIEW AUGUST 25, 2014 AT THE LAGOS, NIGERIA US EMBASSY. HE WAS DENIED BECAUSE HE ANSWERED YES TO PAYING MY DOWRY WHEN WE MET DECEMBER 2013. THEY SAID I SHOULD APPLY FOR SPOUSAL VISA. I EMAILED THE EMBASSY AND THEY STATED THAT PAYING OF DOWRY IS CONSIDERED MARRIAGE UNDER NIGERIAN CUSTOMARY LAW. THIS IS NOT TRUE, DOWRY ESTABLISHES INTENTION TO MARRY. PAYING OF DOWRY ALONE WILL NOT EVEN MAKE ME ELIGIBLE FOR A SPOUSAL VISA SO HOW CAN THEY DENY HIM?

WHAT SHOULD I DO? SHOULD I APPEAL?

I AM SO DEVASTATED. I WAITED MONTHS FOR THIS AND EVEN HAD TO GET IT EXPEDITED WITH THE HELP OF MY LOCAL CONGRESSMAN BECAUSE I AM PREGNANT. I AM DUE FOR DELIVERY IN A COUPLE OF WEEKS AND WAS REALLY LOOKING FORWARD TO MY FIANCÉ BY MY SIDE. HOW CAN THEY DO THIS? NIGERIA IS MADE UP OF SO MANY TRIBAL GROUPS/RELIGIOUS GROUPS, WHAT DOES THE EMBASSY KNOW ABOUT THE DIFFERENT CUSTOMS OF MARRIAGE.

SOME FEEDBACK WILL BE MUCH APPRECIATED!

I'm so sorry that this happened to you. My fiance wasn't present for the birth of our daughter either. It truly sucks, but it will get better and once you get married and file again I'm sure things will work out. My prayers are with you for a safe and healthy delivery.

Also, my Dr allowed us to Skype the delivery so at least my fiance could witness it.

Based on this experience I would say DO NOT PAY until AFTER k1 is issued! He can still pay the Dowrey before you are married, but if the payment can be considered a marriage and thus preclude the issuance of a K1 then definetly learn from others experiences and hold off on payments! Your family will have to understand there are legal implications...

People need to educate themselves about the red flags at the embassy in Lagos before they waste their precious time and resources . They claim you married but if you turned around and reapplied for spousal visa based on that assumption they would still deny the petition. Dowry alone doesn't signify marriage in every custom without the traditional marriage ceremony but that's a moot point at this stage.

We went through the exact situation you are going through back in 2011. I am a american citizen. Trust me I tried to appeal but still no success. My U.S congressman tried to help my case but no success. I wrote letters to a top immigration official here in the US, but still no success. We know how you feel. The only option I had was to go to Nigeria and get married to my fiancé. To make matters worse, my business had a major turn financially. It was hard trying to make ends meet. I did not even have the money to buy plane ticket to return to Nigeria at that time. My fiancé also could not find work in Nigeria. But God had mercy on us and turned things around. It took us two years but I was able to return to Nigeria and marry my beautiful wife. We had a beautiful wedding on April 14 2013. Believe me when I say it was a tough situation we went through together. But is was also a great test for our relationship. We met in 2010, that was four years ago. But what we went through makes me feel that we have been together 15 years.

When I returned to the US I filed for her as my wife. That was last year May 2013. My wife's interview date for visa is actually two days from now September 4, 2014.

However, my strong but humble advice to you is to have your baby and go back to Nigeria as soon as you can and get married. Then file for him as you husband.
