Hi there. My friend arrived here in the states last December,2013 thru K1fiancee visa. She and her husband got married and she's now pregnant to their first baby. She has applied for her greencard/ead/advanced parole and she's just waiting for the result.

The thing is that, she wants to give birth in her country(Philippines) because of personal reason. Her problem is that she wants to know the procedure on what she have to do right after she give birth. Like does she have to apply her baby for a US passport before going back here in the states right after giving birth? Upon travelling, as long as she has her greencard will she have any problem going back here in the states?

I really hope that somebody could give me ideas regarding my friend's situation. I really would like to help her and this is my only way.

God bless everyone.

Info from the US Embassy in Manila > http://manila.usembassy.gov/service/citizenship.html

She can travel and re-enter the US with her green card, yes.

~ Moved from K-1 Process to Consular Reports of Birth Abroad(CRBA) - topic about having child of a USC abroad, not K-1 process ~

She can travel back to the US with her green card and her Filipino passport. There are limitations on how long she can stay abroad without jeopardizing her green card, but if it's only for a couple of months, there won't be a problem.

First, she needs to make sure that the child will be automatically eligible for US citizenship, please see the requirements listed here:

http://www.uscis.gov/us-citizenship/citizenship-through-parents

Second, if the child is a US citizen at birth, he/she will have to get a US passport before traveling to the US. Applying for a passport without the both parents present requires some additional paperwork:
