New ESTA needed with new passport? (split topic)

Hello! It took a while to read this thread, but I couldn't find anything that worries me. I will try to make the story as short as possible.

We been dating for 3 years, my then fiance was visiting me many times as he could afford to retire. I visited him twice in the USA under VWP: last year spring - 5weeks, this year spring - 8 weeks. We got married in the USA 2 months ago and I came back to my home country. We are planning to file for CR-1 in October. I would stay in my home country, he will come to stay with me during this process. We want to go back to the USA together for like 2,5 months while our Petition is pending.

The question is: I got my VWP verified with my maiden name on almost 2 years ago. I am changing my national passport now into my married name; do I have to update my VWP on-line changing my passport# and my married name or I have to apply for the new VWP? As I understand, since my VWP is still valid I just have to log in on-line and update new changes. Would it be any problem? Can they deny my VW?

Should I use my old VWP paper with my old data, grab my old and new passport as an authentication and pray they would let me in?

New passport, new ESTA. It isn't only the name that changes in your passport. A new passport means, new name, new issue date, new expiry date and new document number.

ESTA only allows you to change your address and flight details. Nothing else.

New passport, new ESTA. It isn't only the name that changes in your passport. A new passport means, new name, new issue date, new expiry date and new document number.

ESTA only allows you to change your address and flight details. Nothing else.

Thank you very much. Is there any possibility to be denied? We have NO PLANS on doing AOS in the USA. We want to travel there while CR-1 is pending and come back to finish the process.

There is always chance of being denied. No one can guarantee you entry. Always make sure you carry evidence of ties to your home country, employment letter, house lease/mortgage, car loan etc.

Should you are questioned further at POE, those things might help to convince them that you are not planning to AOS.

Also carry your NOA1 or NOA2, whichever one you have. Also good proof that you have began the process.

Unfortunately, our house is paid off, the car is paid off, no lease or mortgage, adult son, my job is off and on (teacher at the college, working only one - fall semester a year). Actually no ties to my home country as to the understanding of the emigration officers. The only MAYBE positive thing is that I am a middle-aged woman, will be traveling together with my middle-aged USC husband. Well, it won't be a tragedy if ESTA will deny my VW entry, we will eventually pass this visa journey sooner or later.

I was just wondering if anybody else had this kind of experience. Thank you very much for taking your time to answer anyway.

I am sorry, but my question was exactly on how to update an ESTA on certain circumstances, but not on visiting-in general. I have been visiting in-general couple of times. I sincerely think I was misunderstood. You kicked me out of an original thread and I didn't get the answers with different opinions. You made me upset.

Hi, it seems you are concerned around your ESTA application being denied.

In all likelihood, unless you are on a terrorist watchlist or tick "Yes" to any of the questions on the ESTA application, you won't be denied. However, an approved ESTA doesn't guarantee entry into the US. You face a fresh challenge upon arriving at the border in convincing the officer you are a genuine visitor who will return.

Also, when a mod moves your thread to a new sub-forum, it still appears in the original place you posted it, so no need to be upset :)

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

No, Ketsuban, it wouldn't be a tragedy to be denied. So far we've been lucky to be together comparatively a lot. It is a human nature to dream about better I guess :) All my visits to the USA were very fluent so far, though I am being scared to death every time I have to cross the border. I hope my ESTA will be approved and we will try to go from Dublin as I've read they have this border "screening". In case of failure we won't lose our money for tickets and it won't be a long journey back home.

Thank you for explaining about this thread moving to sub-forum as I didn't know how it works. I thought I have been kicked out and felt like an upset kid in a sand box :crying:
