Timeline

The instructions say to submit evidence that you and your fiance(e) intend to marry within 90 days of your fiance(e)s entry as a K-1. Evidence of your intention to marry MAY include a statement of intent to marry.

The next paragraph talks about proof of meeting and gives examples of things to include to show proof.

So the word MAY leaves a lot to the imagination and a lot of questioning as to what is acceptable as "evidence" of intent to marry.

I received an RFE though I included pictures of rings and hand written statements, from both of us and printed conversations regarding marriage in my packet.

Will send again and see what happens!!!

Hello!

I have read in several K-1 guides the need to include documentation of plans for a wedding with the K-1 fiancé petition. This includes agreements with venue(s), officiant, caterer, photographer, etc.

I do not see any reference to the inclusion of this information in the K-1 Visa Guide here on VisaJourney.

Can anybody speak to the necessity of including this information with a K-1 Fiancé Petition?

You only need to prove you meet within 2 years of filing the petition and that you have a sincere relationship and that you intend to marry. Letters of Intent are for that, basically it is an affidavit saying that you intend on marrying your fiance(e) within 90 days of entering the US. You both need to write one and sign and include the originals with your petition. We had ours notarized to be extra sure.

If you can find someone that can officate at a ceremony with no set date in mind then I would ask them to write a letter. We were fortunate enough to have a great person that understood our circumstances that was willing to sign an affidavit that he would be officiating. Since we are being married in someone's home the host was also willing to sign an affidavit. We were very lucky to have great friends and found a great minister. Thankfully now we are through the Visa Process and the wedding is set and plans completed. I wish you the best of luck.

I have been wary and worried since reading this (in a legitimate source) since I also know people who have made plans and lost money, time, and hope when they didn't receive their visa according to plan.

Logically, setting plans for ANY kind of marriage (great point, LionessDeon) without having any guarantee of a timeline makes no sense. However, there are so many caveats in this process it is helpful to hear what you are doing/have done successfully!

Hello!

I was really confused too! I took this pretty literally and I live by "better safe than sorry." So, here's what I did:

I picked out a venue that I liked and I sent them an email explaining our situation and asked them if they do last minute weddings and to send me their packages. They responded that they could help us with our "quickie" wedding and sent me a list of packages. I then attached this email as proof of wedding plans.

This may not have mattered, but we didn't get an RFE, so in the end I'm glad I did it. It was a quick and easy email, even though we aren't even going with this venue.

Yeah, my fiancé will probably say that in the interview. I tried to set everything up to have the wedding when he gets here. It just wasn't possible. So a tacky Niagara Falls wedding for us :) Not fond of a courthouse wedding.

Thank you, all. It has been so helpful to hear your experiences and opinions!

We are going to ask my father, who is licensed to officiate weddings, to officiate our wedding so we also have a great level of flexibility in when/where we officially wed; I will ask him to write a letter indicating his ability to officiate when we receive the visa. I will likely submit several emails between the two of us discussing what plans for the wedding, and our options for a "quickie" wedding; perhaps also the availability of family property for a ceremony should any communication with potential vendors be unpromising.

No way! haha. It's nice to have a popular wedding destination nearby so we can make it semi fun. Although we can't even go to the Canadian side for the better view :P not like it'll be a nice view because it will most likely be December! You'll have to let me know how yours goes! :) Are you doing it in the helicopter?? lol

we received an RFE after 6 months of waiting :(

The RFE states "PROOF OF INTENT TO MARRY. You must submit evidence that you and the beneficiary intend to marry within 90 days of the beneficiary's entry to the United States as a K-1. Evidence may include, but not limited to, copies od the correspondence between you and the beneficiary discussing wedding plans, evidence of wedding plans such as announcements, plans mdd to reserve a venue for the wedding, or any other evidence of your intent to marry one another, including, for example (UNDERLINED: an original statement from the beneficiary establishing his or her intent to marry you within 90 days of his or her admission to the United States.) "

I mistakenly submitted a letter for myself and not for my fiancé.

Does anyone know if re-submitting just letters of intent to marry for myself and my fiancé will be enough for this RFE or I need to include plans for the wedding and venue as well. We haven't made any such plans yet since we are not sure when the Visa will be approved.

Please help. Thank you.

No we're going to do it in front of the falls in the garden. :) It will be a really small one, so we don't need anything fancy, we just want the pictures to come out nice.

You need a letter of intent to marry from BOTH of you. This is all the RFE is asking for.
