Question:

1. Do we have to fill out 2 AOS ( I-864 ) for 2 petitions that were submitted and approved same time?

2. What if the petitioner has no work? Does he need to submit I-864 too and so is the joint sponsor?

3. If both has to fill out I-864 forms ( Petitioner and joint sponsor ) are they using or filling out same forms (I-864 )

if you follow what it says on this page then it will save you lot of trouble.

in nutshell yes you have to send two i864 even if they are in same I130 file

if petitioner has no work then also he/she has to fill out i864 and joint sponsor as well.

No do not fasten two in one env.

BOTH seperate. Do not forget to send Cover letter, without cover letter (bar coded page) it will slow down process or get lost.

Send both separately with certified mail if you like.

I see that your timeline says IR2. If you are petitioning an IR2, that child may be able to become a USC upon entry. In which case the child would need an I-864W, not an I-864. Could you please clarify who you petitioned for?

the petitioner of the I-130 that was filed was the USC stepdad who is married for 3 years with the LPR biological mother of the beneficiary.

Ok. Then in that case, you do have to submit the regular I-864 for each. Since they cannot become USC's based on the their stepdad, they can't use the I-864W.

Of course, keep in mind that if you become a USC, then the children would automatically become USC's as long as they become LPR's and you become a USC before they turn 18.
