N-400 after approved ROC Abuse Waiver

I was in the unfortunate position of ending up in an abusive marriage. Thankfully, I made it out alive. I removed conditions on my GC based on the abuse waiver, which was approved. I now know that permanent residents who removed conditions based on an approved abuse waiver may opt to naturalize after 3 years of permanent residency, even if no longer married to their USC spouse.

My questions is, what documents do I need to include in my N400? There is little information online. Do I include all my proof of Bona Fide Marriage and Abuse all over again, pretty much "re-sending" the same file I sent with my I-751.

Or do I just send the basics: green card copy, fee, tax returns, 2 passport size pictures and filled out N400 form?

They don't require approval of I360 and they must have your info in system already.

On N400, you choose number 5 for Part 1 and explain "naturalization after 3 years of LPR under VAWA - INA 319(a)"

02/06/2015: In-Line for Interview

04/15/2015: Passed Interview

05/05/2015: Oath letter was sent

05/22/2015: Oath Ceremony

Do you have an official source to confirm this?

The best information I could find was the following policy memo: http://www.uscis.gov/sites/default/files/files/pressrelease/PolMem89.pdf which indicates that you must have initially obtained the green card through VAWA; it makes no mention of being eligible under the three year rule if you only successfully filed for RoC under the abuse category.

Ah, thanks for the link. You should be all set then. I don't believe you will need to "re-prove" the abuse, as the adjudicator will review your entire alien file, including the I-751 documentation, when you file the N-400.

Thank you all for your replies! I will send it in and keep you this board posted as to what transpires, if I receive RFE and such, maybe it can help others in the same situation. There's really not a lot of specific information on the topic out there.

Hi all

I just wanted to update my thread for those who might come across it looking up info on the topic...

I did become a US citizen, based on 3 years of permanent residency even though I was divorced from my abuser...So yes, if you have an approved I-751 based on cruelty and abuse, you ARE eligible to naturalize as if you were still married after 3 years of permanent residency.

The interviewer may tell you otherwise, just inform him/her of the above memo and it resolves the situation. Many USCIS officers are not aware, although they mean well...

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
