Now I am starting to make some research and see that after I will send the RFE uscis may approved or Deny her citizenship . I am so stressed I know I cant do nothing now until I see what RFE they need .

Guys I am waiting for the RFE , since our immigration journey I did gave them affidavit from 2 peoples while doing her adjustment status . Now while for citizenship if they do ask for Bona fide marriage affidavit may I use same folks but just get it re notarized or should I look for different folks . PS I did not get the mail yet of what are they looking on the RFE . I am just trying to get prepared .

First of all, I hope this ends well for you and I haven't read anything to make me think that it won't if you respond to the RFE.

Second, your very first statement that your wife passed her interview isn't correct; just to be clear, the decision to approve or deny her application has been deferred until the interviewer gets more information. Initially, it seemed that you didn't know why they would have been unable to make a decision right away, but now it sounds like you suspect that it's because you don't believe your marriage is legitimate.

Without knowing why you might suspect that or what the RFE says I can't guess what they might need... People get. RFE for issues related to marriage, for confusion around their full legal name, for proof of time spent in the US, for information about their parents if one of them is a US citizen... can you tell us what happened at the interview to make you think this is related to your marriage?

It's good to be prepared, but maybe you just need to wait for the letter if you are not sure of the reason. There's no point in panicking now. I assume your wife took her tax returns, joint bank accounts, etc with her to show that you're living together.

Ok I read a little more and I see that you were both married before and both your previous marriages were annulled. That is very unusual so the interviewer might want to verify the annulment court orders to make sure that you and your wife are actually legally married. Wait for the letter.

So you are both applying for naturalization under the five year rule? If so forget what I said about bank accounts.

Sorry if you've explained this before, this is a long thread and I only started a couple of pages back.

Thanks Jimmy , I am a USC . during her interview the IO did asked about my previous marriage and hers also We do have our original divorce paper There I don't see anything will trigger an RFE . But last night I was trying to get as much info from my wife , she is very frustrated and scared . This is what I found out she did passed her civic test no issue also . She said the IO did asked her 2 times if she did took any trip outside . Actually we did take one trip of 20 days visiting paris , England , Scotland and Italy . It was one trip but we stayed 5 days in each country . I did list 26 days on her N400 . but while reviewing that application again I noticed there is another line just below stating how many trip did you took .Dumb on my side I did not put 1 there .Do you think this must have trigger that RFE ? if Indeed this is the RFE I must say that IO who interview my wife is a master of officer to noticed that , I am impressed . I don't really think anything else will trigger an RFE . I don't want to rush into looking for a lawyer as I do think our case is straight forward . I will just wait few more days and check out what do they need . The only thing making me frustrated is I do have everything possible evidence that immigration might need and we took it to her interview if only IO wil have asked my wife will have provide her the evidence right there .

Sincerely ,

We (me and my wife) have interview on 16th March (Monday) at 10:15 AM. We live 120 miles away from Atlanta field office. Do anyone know or provide any information on how Atlanta Schedule oaths on same day? I would really appreciate any help in this matter.

We are now US Citizens. We had the interview and Oath on the same day. Oath was at 2:30PM.

My interview experience:

- Interview at 10:15 Checked in with receptionist at 9:45 on 1st floor. (You can check in only 30 mins prior to your interview time).

- Waited on 2nd floor called in for an interview around 11:30.

- Passed Civic and English test than IO was looking for my birth certificate in all my documents she had all the documents from (H1 to GC to N400). Finally she find it and asked me that I can NOT use my middle name (which is my dad’s name) because my middle name is not written in my Birth Certificate. I told her that my middle name is in my Green card and she argued that it has to be in my Birth Certificate to be on my Naturalization Certificate. (Same middle name issue happened to my wife also her middle name was my first name). We ended up with our First name and last name on our Naturalization Certificate.

- She asked me if I want the Oath same day because today (Monday) they are doing Oath Ceremonies. She gave me letter saying that I passed the test, and gave me the letter saying my application is recommended for approval and asked me to wait in waiting area, once the supervisor approves the application, someone will call your name and you have to collect your Oath letter from them. After waiting about 10 to 15 mins I got my Oath letter in waiting area and asked me to come back before 2PM.

I recommend all to take following documents with you:

  1. Your Original Birth Certificate.
  2. Original social security card.
  3. Birth Certificates of your children.
  4. Proof of address current and previous.
  5. 5 years of Income tax returns.

** Take originals with you if available

My observations on same day Oath:

  • Including us families seating close to us and all of them drove over 1:30 to 4 hours drive to get to there.
  • I think they schedule interviews for these kinds of applications together so they can do Oath Ceremony for them on same day.
  • There were two Oath Ceremonies one around 10:30AM and second one at 2:00 PM.
  • There were about 50 to 60 people in each ceremony.
  • Atlanta office does same day Oath Ceremony on day 3 to 4 times a week.

Good luck to all others who are waiting for their interview and Oath.

On March 18, 2015, we received your response to our Request for Evidence for your Form N-400, Application for Naturalization . Our Atlanta Field Office office will begin working on your case again. We will mail you a decision or notify you if we need something from you. You should receive a decision or case update by May 17, 2015, unless fingerprinting or an interview are needed. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

First of all, a clarification: you said that your wife passed the interview, but that's not true. If a decision was not made then she did not pass or fail They haven't decided yet.

Secondly, someone went through a very similar situation last year Unfortunately I can't remember how it was resolved. My guess is that one of two things happened:

1- they were going to send you a request for evidence and then decided that they no longer needed the evidence. When the request was canceled in the system, it's probably indicated that they had received a reply. In this case you don't really need to do anything except wait until they approve your application.

2- they sent you a request for evidence and there was a mistake in the system that sent the email saying that you had already replied. In this case, you would likely receive the RFE letter in the mail in the next few days.

Either way, if you were sent an RFE you will be given one month to reply So I suggest that you wait two weeks from when they said they sent you an RFE. If you get a letter, respond to it. If you don't get anything by then, you might want to give them a call or scheduling info pass appointment to make sure that they are not expecting a reply from you.

Please remember that this is all guesswork and I really have no idea what's going on This is just what makes sense to me.

Just a correction to what I typed earlier, I see that you've already been waiting for two weeks You could try giving them a call tomorrow, but I really don't think you should be too worried. It sounds like they may have just decided that they already have all the information they need. Try waiting another week and see if your status changes.

Good Afternoon , I just get off the phone with Customer service in regards on the RFE that was supposed to mail to me since March 05 day of her interview . I told Customer service level 2 that I never got the letter and emailed I received yesterday saying my response was received . Level 2 said she don't have any more updates and wait if I don't get the RFE letter by April 04 then make an info pass . I did told her that according to the RFE email it did mentioned that I will have a time frame to reply that request then she said that it does look that the office may not need any further documents from you and they may make a decision before April 4

Any input please I know I just need to wait as I don't have any option . Usually after a text from USCIS I usually received all letter within 5 days and this one have been 2 weeks exactly I want to believe that I wont need to submit any request but I am on a panic mode lol .
