Please help with I-130 processing time!!!

Hi all,

This is my first post. I am a permanent resident of US. Recently I got married in Pakistan. I filed form I-130 for my spouse at the California Service Center.

Please let me know how long it takes for I-130(not the current processing date) to be processed and ultimately for the interview.

2nd question... is there ANY way to bring my spouse earlier than the time period it takes for I-130 to be processed?

The time it takes for an LPR to sponsor an immediate relative depends on the country. It may take anywhere from 3 to 5 years for a visa to be available. You should apply for citizenship as soon as possible to speed up the process.

Unfortunately, once an LPR files an I-130 for a relative, the relative will not be able to apply for ANY nonimmigrant visa. Your wife can not come to the US before the I-130 is approved and she obtains her visa.

When filing for a K3. I thought that your spouse could come to the US once issued a visa. Then await the approval of I-130?

You have to be a US citizen to petition for a K-3.

Didn't pay attention that MQ wasn't a citizen.

I am able to, and have filed for the K3.

SCY, so your spouse is now able to come to the US? According to your timeline, that only took about 7 months to get a visa. Is it really that fast?

Nice to meet you too. Fill in your timeline so others know about your case. You're only the third K-3 petitioner from Vietnam on Visajourney.

K-1 and K-3 are very fast. The slowest part is consular processing in HCMC which takes about 4-6 months after the consulate receives the petition. As you probably know, HCMC is one of the toughest consulate to obtain a visa from. If you don't have all your ducks lined up, your petition will be chewed up by this consulate. I found Visajourney before filing and learned a lot on here. I was able to prepare my petition properly and had a fast approval. You can read more about HCMC in the Vietnam interview thread here:

So your spouse is now able to come to the US, after waiting for less than a year to process the K3? The reason I ask this is because I am uneasy to how long it could take. I have heard it could take years before a visa is processed. But seeing that your situation only took a few months, gives me some hope that I could actually be with my wife within this year.

As soon as the visa is issued, the beneficiary can use it to apply for entry into the US. It may take you anywhere from 6 months to many years to obtain a visa through HCMC. I think that if you read everything on Visajourney and prepare your case, the chance of success is good. I don't know anything about your case but HCMC rarely deny visas. They will delay and delay but eventually they will issue a visa.

The timeline for visa processing is usually:

1-2 months for them to send packet 3 after receiving the petition.

3-4 months for them to set an interview date after receiving packet 3 back.

This timeline hasn't changed very much in the past few years. If you failed at the interview, then there is no more timeline and the consulate will process the case on their own time. This is where the waiting can take years. So don't fail the interview.

I would guess in total, somewhere around the 5 year mark. Best to file now and upgrade if you acquire Citizenship.

I know of no specific exclusion of beneficiaries visiting whilst the process is taking place. From a practical point of view it may be difficult in individual circumstances.

A Visa type that allows dual purpose should not be an issue - H or L for example.

I don't think my case has any reasons for delay really, besides the potential for interview failure or paperwork errors.

I'm still very amazed at how quickly you got yours to the interview. I seriously did not think it could be done that fast.

What are some factors that can make a case go quicker/slower? Besides the ones you listed. Pertaining to HCMC.
